HELLO!

This is the 1st post we start here!!

My husband and I have some questions about the I-864.

At the moment he is living with parents but his income is for his own expenses; later on, when we finish the process (and if we get approved),we are gonna move out to live ourselves, but we are thinking that maybe the first 2 or 3 months we are gonna live at his parents place, in the meantime the house is repaired etc.

1)When he files out the I-864......should he count anyway all the persons living at his parents place? (Because he lives with his parents at the moment)

2)Or should be better to right away state that we are gonna live at our own place (even though his parents are the owners of that place as well) and the household is 2? And skip the plan of living at his parents place....

3)If it's a household for 2, the income should be around 19 000,right?

SO many questions, sorry!

We appreciate your help! THANK YOU

Household count is not based on who resides in the same house. If he does not claim his parents on his taxes, then they are not part of his household size. See the I-864 instructions for all the details about how to count household size.

He counts dependants. His parents aren't his dependants. You are. That's regardless of who you live with/where you live unless he claims anyone else as his dependants.

Household of 2, yes. 18.912,5 is the minimum.

Good luck and do a happydance once there's no more paperwork to be submitted.

Okay, thank you so much to you both Jay-Kay and Moomin for your amswers, we are waiting for NOA2 but we wanna gather all the info and documents needed for next stage (NVC) ASAP.

We were a little confused about how to count the household size, but now I understand that doesn't mater who you live with, it's only gonna be necessary to count the dependants!

THANK YOU!

Oh ONE more thing....For the poverty guidelines, the one that we need is the "Taxable income" or "adjusted gross income"???

We are checking the IRS tax transcript but we wonder which one is it?

THANK YOU!!!

The line that says "TOTAL INCOME". However, for the income requirement they are looking for current annual income, which can be proven with a letter from employer stating position and salary plus recent pay stub(s). If self-employed, then they will go by line 22(total income) from the most recent 1040 form.
