Okay, so we are asking my husbands (the beneficiary in our case the CR1 packet I-130) parents and brother to write affidavits.

1. Can they do the Affidavits?

2. Does it need to be notorized?

3. Can it be notorized in the US even though his parents/brother live in Dominican Republic?

4. Do they need to sign it?

I read that they need to put their name, address, date of birth, and legal status( what do they mean by that? married or single?) Im now sure how to explain to them how to write an Affidavit because im not 100% sure if they need to do it a certain way, and im a person that things way to much and to hard on something, that's why i am asking.

5. Which way is recommended to write an Affidavit?

6. Can you give me an example? Are there any examples of how to write one? (other than the one on this site.. i couldn't follow along with that one.)

Affidavits are simply statements written by people with intimate knowledge of the subject. They arent required as far as I know. They are almost worthless because anyone can say anything about any subject. Doesnt mean its true or correct.

Notaries verify signatures on documents. They have nothing to do with the content. Not required nor needed. Documents must be signed in front of the notary if used.

Legal status would be citizen, LPR ect.

Doesnt hurt to include them but doesnt help either.

We simply submitted our marriage certificate. Married is married. Your marrige is recognized as legal in the US by virtue of the cert just as it is where ever you got married. We werent asked at any time by anyone to prove our marrige. I think you are confused by what K 1 people do not married people.

Submit the required documents and let the process do its job. There are reasons for the design of the process.

Well, I wouldn't say that affidavits are worthless, they could be a good support in the cases when evidence is thin.

In our case, we have sent affidavits from our parents, brothers, best friends who attended our wedding. Maybe it was not a must to send so many affidavits but we wanted to cover that part, since (as you mention) we never rented a place, neither we have a joint property....we are just NEWLYWEDS! and if it's complicated to get that paperwork already living in the same country, now just imagine when one of us is a foreigner!! So we decided to sent ALL what we had available that could be a proof.

You don't have to send it all, but some other evidences you can send to support your application are:

-Pictures of you together through out the time (from the oldest to the latest pic of u together....you can choose, maybe 20 or 30 pics)

-Pictures of your wedding (with family and friends could be even better)

-Copy of your marriage certificate (anything better than this? hehe)

-Copy or screen shots of chat logs (aka Skype, Gtalk, Yahoo messenger, Windows live)and emails

-We have used facebook screen shots (of life events, like when we started dating, when we got engaged, when we changed our marital status...)

-Copy of call logs (if you call each other)

-Copy of passport stamps

-Copy of correspondence (if you sent letters to each other, you can scan the envelope with post stamp and f course each others addresses) like on Xmas, Valentine's day etc

-Copy of plane tickets, itinerary, hotel receipts, bus tickets, etc etc whatever it can prove you have been together at the same place and time

I have explained why we sent the affidavits, in our particular case, I never said that the affidavits are REQUIRED or DESIRED..... :blink:

The point is that the O P asked about affidavits. The point is that there is no requirement to use them. The point is that you want him to believe that the mistake you made in your submission should be repeated by him which would give him a false sense of the value of doing it.

The point is that married is married. Once that has occured we dont need to submit evidence that supports a K 1 fiancee case.

I am also working on gathering affidavits as evidence of the bona fides of my marriage as the other options do not apply for my husband and I.

1. I do not think there are any restrictions as to who can write the affidavit. I am having my parents and a few friends write them for me.

2. I am having the affidavits notarized because the definition of an affidavit is: "a written sworn statement of fact voluntarily made by an affiant or deponent under an oath or affirmation administered by a person authorized to do so by law. Such statement is witnessed as to the authenticity of the affiant's signature by a taker of oaths, such as a notary public or commissioner of oaths."

3 & 4. The affiant (person writing the affidavit)must be present for the notarization. They have to sign the document in front of the notary. The notary then signs the document.

5 & 6. I am still working on figuring out what exactly should be included in the affidavits. Sorry I can't be more help with this part.
