Hi All,

Hope everyones wait times are flying by.

I have a question regarding last name change after marriage. Now im the US citizen petitioning my fiance here. Once we get married, can I remain with my maiden last name through out all the other processes once we get married, like the AOS and the citizenship application and stuff and with my social security card as well? Or will I have to take my husband's last name? I want to take his last name but I need to remain with my own last name for a little while for some family reasons. Will this no name change appear as a negative sign to the people who view his AOS and citizenship forms and such?

Also, how long can we remain without adjusting status after we're married without him getting in trouble with the immigration people?

And how long does the AOS process usually take and the cost of it? Can we get the EAD without applying for the AOS?

Oh, and also, to go through all of the processes mentioned above, will we be required to register our marriage in Turkey via the Turkish consulates here? Or will the offices we will be dealing with here somehow let the Turkish consulates know we're married? Or can/will we remain single in the records of Turkey until we willingly go and change our statuses? When the time comes, we actually want to be in Turkey and have our marriage ceremony performed and certified in Turkey. Not at a consulate's office here. We want to experience that. I hope Im clear enough in what Im asking. we're both Turkish and him as well as I have Turkish citizenship.

So many questions, I know, but I really need answers to these. Thanks in advance to all who read and reply.

I’m kind of confused with your situation?

Are trying to petition your fiancé as fiancé OR husband? I ask seems that you want to marry him to his home country NOT here in the USA....fiancé petition should stay UNMARRIED!! No exception to the rules...OR are you asking after marrying him here in the US that you need to report that to turkey country? Nope the way it work it depend where you get your wedding license there the one will provide the wedding license then the minister or priest will do the report/register/sign the wedding contract.

About the last name change that is your option...they don't force you to change last name as long that you have enough proof that the relationship is indeed bonafide not a fraud!!

After 90 days your fiancé will be out of status no matter what married or not.

You can keep your maiden name; it makes no difference and does not look good or bad.

AOS is $1070, you cannot get an EAD that has any worth without it. (you can get a 90-day EAD based on K-1 visa but it will expire when the I-94 does, and takes 3 months to process, so is basically useless. I think it is worthless to even bring this up, but others will chime in and throw this thread off track).

There is no deadline to file for AOS, but your future husband will not be able to work, get a driver license, travel, or do much of anything until you file for AOS and get the GC approved. It would be negligent not to plan to do this straight away, for your fiance's sake. Sitting at home trapped in a country is not good for a new marriage.

Im petitioning him on the K-1 visa, so as my fiance. The marriage will take place here in the USA.

Ah, I think my tax return check would cover that :)

Yea you're right. He's not going to like not being able to work and pitching in to the income but it is precisely for the financial reasons we are going to have to put off the AOS for couple months maybe. As long as he's here with me, we can see each-other and be at each-others' side, honestly that's all I want. I'll do my best to manage the both of us for a little bit.
