I came to the US with a K1 visa and been married an year and 2 weeks now. Unfortunately things doesn't go good... I just found out that I can file for divorce online... Things like that I love abbout this country! Anyways...

I applied for AOS sometimes in January this year. I don't want to stay in the US after the divorse but I want to have the chance to come here on vacation or for any other reason if I want to in the future... I'm only 24 years old now and who knows what is going to happen. Three years ago I wouldn't ever think that I'll be in this situation today.

Should I call the USCIS or is there a form that I can file? Do I do that before or after the divorce is a fact? How long do you think all together takes because I'm about to start looking for a ticket!

Thank you in advance for the responses!

You can send a letter to the USCIS service center that's handling your adjustment of status and withdraw your I-485. Explain that you're divorcing. Have your signature on the letter notarized, and be sure to include your service center case number.

You have temporary lawful status while your I-485 is being adjudicated. That status will be terminated as soon as your letter is received and your I-485 is withdrawn, and you'll start accumulating unlawful presence. Don't send the letter until you're ready to leave.
