I am the petitioner. My question is ,Im combining my parents income with mine since im a student and my income to support my spouse does not reach. My parents filled jointly for 2011 tax return.

Question 1. Do they have to prepare a separate I-864A each or just one I-864A ?

Question 2. They have a dependent that is under 18 years but however his elder brother claimed for him on the 2011 tax return, do they have to still include him as a member of the household even though he is not stated on the 2011 tax return ?

Please Anyone :unsure:

Yes,myself the (petitioner) do have an income and need my parents to supply a alittle to push it over the mark.

Only one person per form (864, 864A, 864EZ). Have one parent complete an I-864A affidavit of support. With a joint tax return they will use only their individual income when completing the form. Support the past income claims with W2's. Support the current income claim with paystubs and an employer letter.

The 18 year old is most likely a part of the household count. The guidelines state that if a minor child has reached the age of majority based on the laws of the state and is claimed by another they don't count. Typically that isn't true. The simpler path is to include that person in the parents' count.

i HAVE ANOTHER QUESTION.

"Hi, i have a question concerning that same matter. Im sponsoring for my spouse but my income does reach ,so im joining with my mom because we live at the same resident. my mom filed jointly with my dad ,plus they have a dependent but my older brother claimed fro him on his tax return."

#1 My question is , what number do i put for Part 5.Question #21g on my I-864 ?

#2 And what will be the total HOUSEHOLD SIZE together for #21h ?
