hello

i am US citizen and my husband had his interview for CR1 visa not in the native country but in the different country when he was living as student. after his interview CO told him that case need addition AP.

its been a month that our case is in AP . now my husband have to renew his student visa for that country but when he went to renew his visa they told him they cant issue visa because u have case pending in US embassy for immigrant visa.

now i am thinking that might b when US embassy did verification on his status from the country embassy where he was living that created red flag that this person is not a real student he is staying here to process his visa for another country that should be done from home native country. is that possible?

other thing is that if he is not able to extend the visa for the country where he had his interview in US embassy he will have to leave the country. then we have to contact embassy to transfer his case to the embassy in the country of origin back home. is that going to restart AP all over?

what we should do because we dont want to overstay as illegal it can affect our US visa

i dont think the embassies are linked to share such information. I did my application from the uk while on student visa and renewed my visa to a work permit when it expired, and the issue of my pending F2a visa for the usa never came up during the interview.

so i would think he probably informed them himself which was not wise. best to go back home and transfer the case.

he never informed anyone himself. the person in college who was helping to get register and get visa , he said that i spoke with someone in immigration about ur case and they said we cant renew his visa. then we tried to find out what is the reason. administrator said that i will find out the reason behind that . we waitied couple of days and after that he found that he have immigrant visa pending we cant extend his student visa.

tomorrow we will find out that whethe he will be able to get visa or not because his school administrator said that we can write them a letter that he dont want to waste his time by going back home he still want to continue

his studies in the mean time. i seriously dont knw what is going on or what i should do. so upset :(

IT EXPIRED ALREADY BUT HE IS REGISTERING IN COLLEGE HE PAID FEES ALREADY

He needs to show proof of legal presence in Ireland in order to be interviewed there. If he cannot get a renewal, he will have to go back. I don't think they will care one way or the other if he has paid fees, if they cannot renew his visa they will not.

I am from Canada, but interviewed in New Zealand as I had permanent resident status in that country. If I hadn't got that, I would have had to go back to Canada to interview.

I can explain it to you. But I can't understand it for you.

i really don't think you have a problem yet. apply first get the letter from the school and see how it goes. i understand you said you asked someone about it, well i wont be to fast to believe everything. perhaps the rules in Ireland are different, i don't see why renewing your student visa when u are still on a course should be difficult and why and already existing application for another country should affect it.

when your renewing your visa for a country the only information visible to them is what they have on their system for you in their country. the only time they go far to check other information is when you have a criminal record or fraudulent activities.

i dont think you should be worried that much lets see how it plays out.

nevertheless you need to have a resident permit in any country you are applying from.

i am praying so hard that he dont have to go back home otherwise he will be in AP forever. he told me that so far even though visa is already expired and he is trying to register in school , he is not gonna be considered

illegal as they can register with any school within 3 months. now i am concered that what if he dont get student visa and also he overstayed on visa that is expired , is there going to be any problem?

what action he should take before leaving country to make sure he didnt stayed illegal?

should he get any letter from immigration before leaving that states that he didnt overstayed and he was only trying to get his visa extended .
