Interview on the 11th question about docs

I'm the American and my husband is from England. Our interview is on the 11th. I was married previously but divorced. Will they need my marriage certificate from my previous marriage? My ex still has that and I'm not in contact with him. I do however have my divorce decree. Do I need to order a certified copy of the marriage certificate? Thanks in advance!

Never heard of them asking for a marriage certificate. Only the divorce papers. They want to make sure you are not a polygamist.

You won't need it. I know that you are the USC, but in England you have to surrender your marriage certificate to the court when you are divorced so I wouldn't have been able to produce mine.

Hi Angela - can't believe I have actually got the nerve to be giving some advice here as I'm such a newbie but thought I would give it a go since your situation is similar to ours. In my case, I am the UK citizen and was married before in the UK. From the page on the embassy website where it tells you what to bring to the interview it actually says that you have to have a marriage certificate, or a certified copy, for any marriages which have been dissolved. I got a copy by ordering it through the local registrar here. Perhaps it is different for you as an American and therefore as the sponsor, presumably?

Hi Angela = here's the link (sent to me by Nich-Nick)

http://london.usembassy.gov/application_documents.html

and cut and pasted below is the relevant paragraph:

Marriage Certificates: Married applicants must obtain an original marriage certificate, or a certified copy, bearing the appropriate seal or stamp of the issuing authority. A certificate is required for all marriages, including those that were dissolved.

But as I say, maybe this applies to your husband and not to you?

Despite what the website says, I don't think either of you will need the certificate showing a previous marriage. Your marriage certificate to each other would be appropriate. The list of documents is for the person going to the interview, so no documents about the USC anyway (except the affidavit of support things). And if you are CR1, they will be sent to the NVC and will already be in the file when he gets to the embassy.

We did a K1, but the embassy list is the same for both. And it said the same thing when we were preparing. We both had been previously married and he did not need anything from prior marriage but the UK divorce decree.

Thanks for clearing that up Nich-Nick. On the one hand, as a petitioner, you want to use common sense but on the other you feel obliged to read every minute detail on the Embassy website so that you don't miss any of their requirements and then follow it to the letter. Thank goodness for this site and for the lovely people who take time out to help and advise others on this long, difficult and complicated journey!

Good luck Angela!

I read something a good while ago on another site and the UK beneficiary was asked for their marriage certificate from their previous marriage but ive not heard of any USC's being asked.

If its not too difficult to get one and it will put yours and Stewart's minds at rest then personally i would get it anyway. I've got far too many things that i KNOW i dont need because theres no chance im giving them any reason to have me walk out of there without an approval.
