Just wanted to know if i wanted my fiance to come here just to get Married, and then we both go back to U.K. how would we go about this? do we still need the K1 Visa? are can he come for a visit then get married and leave. Would they accept this? do we need to apply for something new? and what happens to our the K1 Visa? :unsure:

There is no need to do a K1. He can enter under the VWP if he is only planning to come for a vacation and wedding. Plenty of people travel to the US for a destination wedding. However, as he is marrying a USC, he should bring evidence of his ties to the UK in order to show that he does not intend to stay.

If you both later want to go to the US to live you would apply for a spouse visa - the CR/IR1.

Your fiance can come as a visitor to get married in the US and then leave, but just be prepared that there would be extra scrutiny at the airport when he enters, because entering to marry a US citizen often is part of a plan to enter, marry, and then file for adjustment of status in order to get a spouse-based US resident status without all the waiting in separate countries. Obviously this is not the case for you and your fiance, but the assumption is default and you have to overcome it. Make sure he has on-hand proof of the intention to return to the UK after the wedding, and proof that you'll be going there to join him and live. This battles any assumption that he'll use the entry permit to seek an adjustment of status later.

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

Did you already File for a K-1 Visa ? Yes, it will be null and void if you marry upon your actions not to adhere to the guidlines of that Visa. If you did File for a K-1 and decide to just get married instead then I do see a problem entering with a currant Petition to Marry based upon the K-1 Rules. The intent you state: Is to come for a visit, but that is not the plan. That is Fraud.. I'm sorry.. It is. You are telling us: I wanna see what I can do to bend the Rules and make this work for US. COME FOR A VISIT>>GET MARRIED AND WE BOTH LEAVE.. On a Visitor Visa. Ever heard of a Paper Trail... Well, this is one.

My advice would be... If you started the process and Filed a K-1 Cancel it. (there is a USCIS record) . Or continue with the currant Petition if Filed.. You will need to Cancel any Currant petition such as a K-1 if you plan on marridge before its approval. Remember, the INTENT of any Visa to be or not to be is up to another person/entity of the Goverment which you have no control over. Be really careful about your actions. It will kick you hard... go by the rules and it will be much easier and avoid entries, denials. You are to new to this for looking for "shortcuts".. There are No shortcuts... The USC can fly to the future Spouse and Marry and then Petition a Spousal Visa Request/Petition. There are other ways but, the Intent wasnot a Tourist/Visitor Visa when that was not the Intent. So this is the best I can say and not violate TOS.

If you want to Marry and bypass the K-1 then do it the right way. Get married a File a Spousal Petition.

We had just decided that this may be the best for us. i really was not sure how to go about this, and had plan on having a wedding here before we decided to just go back and live in U.K. but really wanted my wedding to still take place here so my family can attend. I hope that they will let him in the U.S. when he tells them he coming to get married :yes:

We filed for K1-visa then he just got a good job that would be better for us in the U.K. since we started the K1 visa i didnt know if we should just go through with this, because we would be leaving after we get married just was not sure how to go about this, was not trying to avoid just wanted to know since we where not going to stay. would k1 since be relevant to us?
