Hi all we just received the I-130 approval for my spouse Question we got married last year and have lived together 5 and a half years .I just got a new job starting next week and is enough for the I-864 but as i said am just staring it.

Can we include his/spouses imcome for the past 3 years or just the last one where we are married ? Also will they look at my new job as evidence to support spouse..

Thanks All

MAry

Have a Great Day,

Regards

Mary

If your spouse was LEGALLY working in the U.S. and the source of income will continue then you may include it in the affidavit of support. If the spouse is working illegally then you may not include the income. What will matter is current income so including past one year or five years is not really an issue as far as your spouse's returns if the spouse was working LEGALLY. You need to prove sufficient current income by way of pay stubs, letter of employment, etc.
