That's really a question your fiance needs to consider as this site only concerns US law, not UK immigration law. I do know there is a 6 months residency before you can legally marry in Scotland, and you will be moving your son with you as well.

I know it stinks to be apart. I understand that. I know how every day apart is heartache. But -- and I don't mean to be mean here, just honest -- you and your fiance are adults. This process doesn't take that long in the grand scheme of things. Stopping the K1 now to get married, or file for a UK fiancee visa, is just going to add more money, complication and possibly time. I mean this in the best possible way -- you need to act like an adult and not like a heartsick teenager. Look to the ultimate payoff and not the short term. Keep the K1 process going and be patient. All of us on here have had to be patient in one way or another and we've all lived with it.

They're more strict than moving to the US. You don't have any friends who can be your co-sponsor? I agree with Honey Crumpet. It's tough and it stinks but we've all been through the same wait. You'll make it through and you have the opportunity to visit, so that will help. Call your friends or relatives and see if you can find someone who's willing to help.

Has there been any though behind your decision or are you just trying to be together as quickly as possible? There really won't be any difference in terms of time and you can visit eachother as much as you life while the visa process is ongoing (check below)

You can't get married and just stay. You will have to return to the US I beleive.

What will you do for work in Scotland?

Where will you live?

Do you really want to live in Scotland over where you are.....Scotland is rubbish!
