Hi,

Can anyone help me or point me to the right direction in Petitioning my mother(she's in the Philippines). I am a US Citizen and we had to moved here in Korea on Military orders (my husband is the Active duty). I'm not sure where to post this, or is this even possible to start my Petition ...

Yes you can petition youre mom now even though you are in abroad. My mom is under petition right now it is under IR-5 ( parents of a US citizen)

I'm not sure exactly what you should do but considering that neither you nor your husband currently live in the US your mother's visa may be denied. This would happen because immigrant visas are to reunite families and if you are in Korea & your mother is in the US where is the family reunification? Your mother may be able to get a visa if your family will move back to the US soon or there is a pardon for military families. I could be wrong, hopefully someone will come by and help you more with factual information.

The process is very similar to the IR-1/CR-1 path that you went through to get your green card. Start with the I-130, Petition for Alien Relative. In about 5-8 months, USCIS will approve the I-130 and forward the case to the NVC. The NVC will send you a fee letter. Then you will need to file Form I-864, Affidavit of Support. Your mom files Form DS-230 for an immigrant visa. She interviews. She gets the visa. She enters the US and automatically gets a 10 years green card.

You do have a MAJOR problem. As someone has mentioned, family based immigration is about reuniting families in the US. With you residing outside the US, a visa will not be issued to your mom.

For the I-864, you must have a US domicile. A domicile is a legal US resident. Without a US domicile, the I-864 will be rejected. The case will be denied. There is no work around for this requirement. It is an absolute requirement.

Wait until you are ready to return to the US to petition your mother.

Agree with Aaron. I know you have a somewhat unique case in that you are stationed abroad as part of the military but your mother obviously won't be allowed to join you on the base so there is no family reunification at this point. You need to wait until you are getting close to returning (you can petition slightly earlier once you have established US domicile and can show you will be returning at the same time as your mom). Or, if it is your spouse who is stationed, you could always move back to the US. But you probably don't want to do that.
