I have a question for anyone who can answer . We will be going with the K1 visa . One question i have is this . I recently went on disability at work and they recently let me go saying I abandoned my job . I am currently in appeals and will likely be getting my job back with my union's help . I am currently collecting disability and when that runs out i will have railroad unemployment . I have to wait for my appeal date which will be in Jan . Will this count as income ? I am also in the process of starting my own business . Will that be good enough to prove support ? I am hoping I will be getting my job back before I get to that point , but i want to be prepared if that is not the case . Thanks for any help or advice in advance .

The disability and unemployment can be listed as income on the I-134. However, they may not accept it if it is your only means of income because it is temporary. Hopefully you will have your job back by the time you need to present your financials. It takes quite a few months to get to that point, and the time can be extended if it needs to be. Planning to start your own business will not help with the affidavit of support. They need to see current, ongoing income. The criteria used for those that are self-employed is what is on line 22 of your most current 1040. A plan for a business and just starting it won't help with that.
