Am in need of your help, please. I had applied for VAWA in 2009, got my work permit (now expired) and was denied 1 year later because of lack of evidence of abuse. I finally got divorced and re-married to my wonderful husband in 2011 (we have been living together for 3yrs now).

The problem is my husband is sick and had to quit his job last year (2011).

1)Should my co-sponsor add my husband in I-864 #21 (e)?

2)Should my husband fill out the I-864 even though he's not working now?

3) On the I-485 should I put the old alien# from my previous marriage or should I put none?

4) Should I put yes on the I-130 #16 and tick denied @ the bottom of that question?

Am super sorry for the inconvenience but I can't afford a lawyer? Please give me some answers, all these forms are driving me crazy :-( Thanks in advance.

Is your current husband a greencard holder or citizen? You posted this in the "Bringing Family of greencard holders" forum and if he is a greencard holder, you cannot adjust status based on marriage to him.

1. I don't have the form in front of me so don't know what that is.

2. Yes, your husband dis still primary sponsor with whatever income and assets he has/ even if he has none.

3. You out your alien number

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

1) If u have any other dependents, enter the #. Should my co-sponsor add my husband since he is not working now?

4) Has your relative ever been under immigration proceedings? Is it ok if I tick yes or deniend, since I had applied for VAWA (denied) in the past?

What status, if any, do you have now? What visa did you come in on?

1. Your co-sponsor doesn't include your husband unless they listed your husband as a dependant on their most recent tax return.

4. Not sure. I think that applies to having been in deportation/ removal proceedings. A lot will depend on what happened after your VAWA was denied; were you ordered to leave the country but did not? Did you stay legally in some way?

I don't know much about this forum, so I just posted my question.

I came to the US as a J-1 student for 4 months n got married to my ex-husnand. After my VAWA was denied that was it, I wasn't in any removal/deportation.....so that was d final outcome(denied bcaz of lack of evidence of my abuse).

I don't have any status now, so my hubby wants me to send in mu paper work asap. As I said we can't afford a lawyer, so we have to fill out d forms by ourselves.

You cannot say yes because you have never been under removing proceeding. You just have a VAWA that was denied. Who knows they might be looking for you but thank god they haven't found you yet. Get your application in ASAP. At least you will be pretty much legal till they make a decision..

Yes, put previous A- number. Much easier for them to locate your file.... Also husband is your primary sponsor so he has to fill out I-864...employed or not...:)
