Hi:

My fiancee and I have decided to get our marry certificate after she arrived in US, her interview is coming up in few weeks in China. We had our engagement/wedding party in china so that all her family and my family attended (chinese tradition). We decided to call it engagement party even though it's kind of a wedding party, and we have planned to have another one in US after she arrived for my co-worker and friends.

My question is : Can I show those pictures that her family and my family took together during the party? see attached..To prove our relationship? Or this will cause an alarm and the consulate will turn back and direct us to change the visa instead of K1 to K3? Technically we are still just engaged IMO. Any opinion is helpful Thank you!

Best regards

Wing

Being that it is tradition, the CO should be aware of this. You can use engagement party pictures just fine. However, they shouldn't give the appearance of a wedding party. I can't tell you where the lines are drawn, but pictures of a "party" shouldn't be a problem. Just don't submit anything that could mislead the CO into believing you are already married. It is really left up to your judgement in what you decide to submit. Yes, you may only be engaged at this point, but you need to be able to prove that and nothing more. If you aren't married, don't give anything that would suggest you are. If you are married, K-1 is not for you.

If the CO thinks that you are married in any way, shape, or form, an approval of your K-1 could be delayed. Take caution with what you say and present to the CO. You don't need to have a ton of pictures in order to prove your relationship. Just choose what you show the CO wisely. Less is more in this case.

From the Chinese point of view, the picture does look like a wedding party, party the Hong Kong way... Do you have other "less wedding" looking pictures to show at the interview? This picture could be a red flag!

Those types of photos could be a construed by the CO as wedding photos, and may result in a denial. It is all about the perception of the CO at the interview. Use those types of photos with caution.
