hi everyone, i have a question. both me and my fiance are Catholics. we have to go through the church prep and marriage here once she gets to the US. i have a question about the AOS. is it ok to apply for AOS after the 90 days of I-94? the reason i ask is because we will get marry before the 90 days at church, but i am afraid that we will not have enough time to obtain a certified copy of our marriage license for the AOS application. Thanks for your advice.

On the I-485 Instruction, number 10, who is not eligible to Adjust status? I am a confused about the requirement here. for 10 D, it is stated that you are not eligible to adjust status if your authorized stay expired before you filed this application. I believe this is the I-94 90 days requirement. for 10 F2, it is stated that You failed to maintain your nonimmigration status, unless you are applying because you are: A K-1 fiance or a K-2 fiance dependent who married the U.S pertitioner within 90 days of admission. Does that means we can submit her application after the I-94 expired?

YES

There is no requirement to file the adjustment of status within a specified time period.

Also, talk to the priest now to make sure that your marriage occurs before the 90 days are up. Other VJ members have had the process altered to comply with the 90 day requirement. Day 91 marriage = big, big problems.
