My father enetered the US in 1983 from Samoa and never left. The only thing holding him up is an I-94. He cannot prove he entered here without his passport (lost). What do I do? The lawyer asked for support letters from people he came with who could vouch for him, but it has been almost 30 years. He flew from Samoa and the only plae we fly through to get to the US is Hawaii. He had to have entered legally as there was no other way. Any suggestions?

What did the lawyer suggest? Isn't he skilled in immigration processes? What about applying for replacement I-94? I guess the information required to file that is not known anymore. Does he remember when he flew in? What day, airlines, etc...

Usually to prove you entered legally you need either (1) an I-94, or (2) copies of entry stamps in your passport. Often, they will ask for both.

If you cannot obtain a replacement I-94 (obtained by filing an I-102) and do not have the passport he entered with (to show the stamps) then it's likely he will not be able to prove a legal entry.
