My boyfriend and I met in 2007. Things did no go past a few romantic dates and kisses. My vacation to DR was pretty quick that summer. After that we kept in touch but things took a twist in July of 2009 when we saw each other after two years. This is when the relationship really initiated. When 2010 came along we both decided that we would concentrate in school and took a break from the relationship. During that break our lives continued and we even saw other people. I dated someone for a few weeks, did not take precaution and conceived my baby. The last time I saw this person was at 7 weeks pregnant. His preference was abortion, mine was not. Long story short he has never been in the babies life and does not appear on the birth certificate. My BF was hurt, however once the baby was born in May 2011 and I traveled to DR again in July 2011, we were able to talk things through and decided to give it another shot. The baby and I went to visit again for spring break in March of this year.

I guess my question is, because there was a baby conceived in between the relationship and there was a break can we still apply for the K-1. In July of next year it will be two years that we decided to take on the relationship. We hardly have any pictures of that time because I had just given birth and was not feeling the pics!!! But I plan to go again in December and we will deff. have lots of pics. I also have chat records from 2009, phone records from 2009 forward, chat records from March of 2012 forward (this is when I finally purchased a Blackberry), letters, hotel receipts etc etc.

I just want to know if I have the green light to start our case. Sorry for the long post and thanks for any feedback! I am new to all this and am grateful to have found this site!!! :unsure:

For the petition, you only have to prove you have met in person within the 2 years prior to filing. You do not have to be in a relationship for the whole prior 2 years.

Having split up and giving birth to another man's child might come up at the interview stage though. Having enough evidence of a bona fide relationship and explaining honestly about anything they ask will help overcome any doubts the interviewing officer may have. Take more photos and keep all the evidence of your next visit to present with all your other evidence at the interview.

Awesome! This is great news. I am ready to explain everything in regards to the baby. The biological dad does not appear on the BC, I just never saw him again. In that case I think it will be to my advantage (hopefully. I hope they do not give me a hard time, I am not sure if I should go into details at the time of the interview (explaining in a quick summary my history with the baby's biological father). However I plan to tell the truth and nothing but the truth....that should help!

That was one of my biggest concern in my case too because my fiancé's daughter was born after we met even though me and him were not in a relationship by any means. He was seeing other people and so was I. Thank God we were approved and both of their visas were issued. The CO never once asked me for the permission of the baby to travel, they didn't ask about his previous relationships or about the babys mom. Even during POE they didn't ask for the authorization to travel...however be prepared to answer questions about that but if there are no red flags in your relationship you should be fine. Good luck! :star:

Your baby should be a concern, thing happen, and although you guys went you separate ways at one point, the requirement is having meant physically in person within two (2) years which you both have... I recommend when filing your K-1 just make sure to explain how and where you guys meant and make sure to include the dates you guys meant (with 2yrs) And for as proof although you don't have many picture, just try to get a few of yous guys together, as for the proof you have of chat longs, call records, all this is very good proof to send in with you application.
