I have made the petition for my husband, I am a USC living in Europe and plan to return home (with him hopefully) at the end of the year. The waiting period for approval of the I-130 is approx. 5 months. What will happen after the I-130 is approved? What is the next step? I have understood from a tax adviser, that my husband must have all his assets in cash prior to moving to the States to ensure he is not also taxed by the IRS on assets earned abroad prior to his retirement (he has never lived in the States). Will he have to liquidate his assets (selling a house, etc.) prior to any further steps in the process? Thanks very much.

well done filling the i-130, I'm going to file it for my husband too but I live in Africa... can you tell me which address did you use in part B question 2 ? like the US one or the Europe one.

The I-130 process if u get sent to VSC is about 6 to 8 months. CSC about 3 to 5 months.

then your case gets sent to NVC where that's been about a 2 month process. Than you are waiting for interview.

That's why we say about 8 to 12 months from start to interview.

Why would your husband have to have assets? You the Petitioner at the NVC stage have to show Affidavit of support and meet the 125% poverty guidelines. If you can't you will need a co-sponsor.

Unless you were going to have him sell all his assets and deposit in your American account. Assets are calculated at 3 times its needed meaning if he deposited $30,000 its calculated at $10,000.

Don't know how long you have lived abroad. But if you don't have domicile setup here you will have to show that also.

Also a note if you file while still abroad using ur foreign address it seems to put you in a faster processing queue. Might cut off some months of waiting.

I sent the I-130 to Chicago and it got forwarded to California. I used our European address. We'll be retiring and he has most of the money - we've kept our finances separate due to the IRS' increasing claims on US expats. Our house is in his name. I'll have my retirement income - which will only be about $2500/month, he'll have his retirement pension which will be a bit less, otherwise he'll have the capital from the sale of the house. We purchased (he paid by cashing in a pension fund, but it's in both our names) a home last summer in the U.S. I haven't lived in the U.S. in 40 years! So if they're expecting ME to support him, well he'll be supporting me!

Well for 2 people the poverty guodeline is at about $19500 so your $2500 a month would qualify.

Yes as the petitioner you will be doing the I-864 form not him.

You need to read up on the setting up domicile in US because that will have to be shown a place to live, bank accounts, voter registration, kids in school, list is endless.

You went to california and filing from abroad you may hear any day so stay tuned.

Read up on the NVC stage a lot od document gathering there as well.
