Apply I130 After 2 Years Marriage Get CR1 Green Card

we got married in 2009. i apply I130 in 2011 his interview in Nov. but his case under AP so he got his visa in june 2012.

his POE in July..today he got his green card its says he have CR1 visa. but on his POE i ask to officer about he gone get CR1 or IR1. he says he gone get IR1.

but still he got his CR1. also on his Green card in middle name they just put first letter on it not full middle name on it. should there be any problem.

so please tell me can we apply for IR1 for now or do i have to wait for 2 years to wait for removal conditions.

02-23-2011- I-130 Application Mailed to Chicago Lockbox
06-15-2011- NOA2 Status Update(Priority Date)
Your I-130 was approved in 104 days from your NOA1 date.
NVC - 08-01-2011- NVC Received (After 48 Days)
08-19-2011- NVC Case# & IIN Received by email from NVC & E-mails Exchanged (After66 Days)
10-04-2011- Case Completed 10-07-2011- Called NVC and Received Interview Letter by email
NOV-2011- Interview (AP)
06-05-2012- Visited at Embassy Second Time
06-08-2012- Received Message from VFS Collected on 11th asking for New Medical
06-12-2012- Medical Done Send Back on 14th
06-25-2012- Received Message From VFS Collected on 26th asking for New Passport Clearance gone be Expire on 28th.
07-10-2012- Send Back New Passport & Passport Clearance
07-16-2012- Received Message Collected on 17th July He Got His Visa.(less then 8 months)

07-31-2012- POE

08-08-2012- Green Card Received for 2 years

05-12-2014- Apply for I751 at California

05-23-2014- Received letter said tht apply for I90 (incorrect card because of uscis error)

06-10-2014- Send I90

It is okay if they just used first letter of middle name instead of full. It is common practice here.

In my case, I entered in US after 2 yrs of legal marriage date, and I believe I am qualified to get IR-1. I booked my appointment for USCIS Field office for Aug 28th. After meeting with immigration official, I will post the update here, to share what they gave me the instructions.

Of course, alot of expert VJ members have mentioned that we are required to file I-90 with no fee as USCIS error. But I am just going to meet the immigration officer to find the best solution for my situation. Because when you submit I-90, you are required to submit original Green Card.

Look at the actual green card expiration date. If it's two years after his entry, it's wrong. File the I-90 with no fee and have a 10 year card issued indicating IR1 status.

Facts are cheap...knowing how to use them is precious...

co ask him only 2 question where do you meet your wife? and second who else in usa without your wife's family.
