What are we to do now??? The San Salvador embassy just called my fiance to confirm his interview date and told him he needs to bring his two children (one 21 y.o. and 16 y.o.). Problem is, they are in Mexico in the custody of their mother. .

We are going to ask tonight if they can or would like to come but if they are not able to attend (as they are not interested in joining their father), will this be a basis for denial?

I mean we can't make them go to the interview especially that they are living in another country and he doesn't have custody. :( What do we need to do so this doesn't become a reason to deny him?

Also, I would have posted this in regional forum but since San Salvador is small country, there's not much activity for us here so I'm just hoping others could enlighten me on this. This is so stressful for me!

You need to talk to the embassy and explain the situation to them. But do you mind if I ask, if they are in Mexico, in the custody of their mother, why is he applying for them to come to the US? And if so, why can't they fly back from Mexico to attend the interview.

Thanks for your response.

We included them in the application in case the 16 year old wants to follow later. Just in case he changes his mind.

I just am not sure now what to do now except wait. But wondering if there is some type of waiver we could fill out?

If they are not interested in joining their father, they need not attend the interview and it will have no effect on your fiance (their father's) visa if they do not. For some reason, the embassy thinks they wants visas, you need to correct that assumption.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Often children listed on the K-1 petition are automatically included for the interview. Like Penguin said if they are not immigrating no need to worry about it or have them at the interview. Just tell the IO that the children live in Mexico with their mother and at this time are not interested in immigrating. Nothing to be concerned about.
