Hello everyone,

So we got ourselves into a bit of a pickle. Ordered some copies of our Marriage License and when I looked at it I realized my mother's maiden name was spelled Linch instead of Lynch. (I am the US Citizen). I don't know how I missed it when getting the License for our Wedding Celebrant to sign the day of the Wedding because I am usually very meticulous and paranoid when it comes to paper work. To get it changed I have to submit a petition and a court order to get a date set to appear before a Judge in the court to have the court order signed for a change to be made. There is the problem, we live in Texas and really don't want to have to fly to Virginia for one morning. I am currently attempting to have a judge agree to allow us to appear by phone conference, and if that doesn't work then look into using an attorney to represent us (might be cheaper than airfare/rental car).

Is this a major issue that could result in the application for AOS being denied?

Once I receive a signed copy of the court order could I continue with submitting the paper work and include a certified copy of the Court order that the name is being changed?

Well like u said try the conference call n, I had the same issue there was a mistake on my passport missing an H so had to file the petition which is actually expenive around $490 i think but anyway the process is not that difficuilt but the court will make it seem difficult and long to make things faster try calling them and explaining it is an immigration issue thats what i did since they will tell you the wait time is almost 4 to 5 weeks. I got mine within a week, i called a case manager they are the one who schedule the hearing and she asked me to come in the judge was having his lunch break when i walked into his office with my son he signed it without even asking to swear an oath or even my wife present or look through and told me good luck. So give it a short with calling all they have to do is correct it

I'm kind of confused, you only need to send a certificate, not the license itself. The certificate wouldn't have your mother's information on it. I guess you could send that but it would seem like maybe it would be easier to just get the certificate stating you were married on such and such date to whomever and then in the meantime work out the marriage license fiasco when you have more time (if you're in a hurry). Guys, feel free to correct me if I'm wrong here.

Total elapsed time between filing I-129F to GC in hand 569 days or 1 Year, 6 months, 22 days.

I'm kind of confused, you only need to send a certificate, not the license itself. The certificate wouldn't have your mother's information on it. I guess you could send that but it would seem like maybe it would be easier to just get the certificate stating you were married on such and such date to whomever and then in the meantime work out the marriage license fiasco when you have more time (if you're in a hurry). Guys, feel free to correct me if I'm wrong here.

A Virginia marriage certificate does have the Mother's maiden name on it I believe. I think it displays the same information on the marriage license but it is certified by the Govt. I am in the process of calling the Virginia Office of Vital Records to find out what information is displayed on the certificate... If I ever get off hold that is.

I had my middle name misspelled in my marriage certificate (I am the USC). We submitted everything as is for my wife's AOS and also attached a letter notarized saying that the middle name was misspelled. We were a little worried about the discrepancy and to our surprise it didn't even come up in our interview. The only name check the interviewer did was on the birth certificate. So yours also might not even be a problem.

Did you get the notarized letter from the marriage certificate office or did you just write it up yourself and sign it in front of a notary?

Yes, I have had a long dislike of Virginia since I lived there for over 20 years and grew up there. Life is so much easier in Texas. We were literally in tears with how easy it is to make corrections to the ML in other states. Just a form, a certified copy of the incorrect ML, and some form of proof.

I agree, Although I haven't been in an interview, I am still waiting for the NVC to give me a schedule date. My spelling of my name should be "marianne" but in the birth certificate it's "mariane", in my marriage certificate it's "MARIANNE" so what I did was, I followed what my birth certificate spells. From my passport, police clearance, NBI clearance, visa application I used the spelling of MARIANE and thank God i have reached to this point without having that issue. but anyways I will update you whatever outcome I have after the interview... of course i would also have the initative to go and appeal to National Statistics Office :)
