Ready to file I-130 and I-485 concurently - please verify my docs.

Hello VJrs!

First, thank you all for this awesome info. I have learned a tonne on here, things which otherwise would have taken me a lot of time to find out. So thank you all for the neat info!

My case;

- Came to the US in 2003 on F1. Graduated in '08 and worked for a year on OPT! Went back to grad school, finished and got another OPT then H-1B, which I currently hold - expiring in 2014!

- I recently(July 2012) got married to my wife (USC) whom I met back in 2006 and I am sending AOS forms. Would you take a look at what I have and see if I'm missing anything? Thank you all good people!

Wife (USC): I-130

1. Check in the amount of $420

2. Completed form G-1145

3. Completed form I -130

4. Copy of our marriage certificate

5. Copy of petitioner’s (wife - USC) birth certificate

6. Copy of beneficiary’s passport (all pages)

7. Completed petitioner’s (wife) form G-325A

8. Completed beneficiary’s form G-325A

9. Copy of I-797A (approval notice) showing beneficiary’s current H1B status.

10. Copy of petitioner’s visa and stamp showing her visit to my home country in 2009

11. Copy of our house deed

12. Copy of our joint bank accounts statement

13. Copy of our joint auto insurance cards

14. Copy of our health insurance showing that we are on the same account

15. Petitioner’s passport style photograph (1)

16. Beneficiary’s passport style photograph (1)

Husband (non USC) - I485

1. Check for $1,070 (filing fee for form I-485, $985 and Biometrics fee, $85)

2. Completed form G-1145

3. Form I-485 Application for Immediate Relative (Spouse) Family-Based Adjustment of Status

4. Copy of Marriage Certificate

5. Form G-325A, Biographic Information for Non-US Citizen Spouse

6. Copy of Alien Spouse Passport (All pages)

7. Copy of I-797A (approval notice) showing beneficiary’s current H1B status.

8. Two (2) Passport style Photograph for Non-US Citizen

9. Medical Form l-693 (Sealed envelope by the Civil Surgeon)

10. I-864, Affidavit of Support and Supporting documents

- Copies of most recent 3 years Federal Tax Return (2009, 2010, 2011) - W2s and 1040

One last thing, can I send my personal check (none USC husband) for I-130 even though it's my USC wife filing the petition.

hey! I see you're ready to file all the forms.. I am struggling with this issue right now. I dont know what forms I have to file to USCIS applying for green card though marriage.. The official website says it must be I-130 and I-485. But why are you filing the other forms? If you file all that dozen of the forms, are you doing it in one envelope or in two different?

Please, share with me some information.. I have to hurry with my preparations but I barely understand what to do

You send everything together. All the additional forms that you are confused about are clearly explained in the instructions for the two main forms, which are the I-130 and I-485. If you read those instructions carefully, it should all be fairly clear to you. There's also a good guide for this process under the "guides" section here on VJ.

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

I am not sure if we need to send form G-1145 for each form. I think one would be enough. Please guys correct me if I am wrong, it would not matter who is paying petitioner or beneficiary as long as amount is correct.

I believe you are correct. my husband and I attached separate G1145 forms to the I-130 and I-485 and I was the only one who received all three notifications.

Removal of Conditions
07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.

Yes, you only need to send one G-1145. That's all they will look at anyway.

The instruction says "You include a copy of the Form I-797C, Notice of Action, of an approved Form I-130, Petition for Alien Relative". But if I am filing all the forms together including I-130 and I-485, where am I supposed to get this Form I-797C? Do I have to file I-130 first and only after that to file all the other forms???

If you are filing concurrently, and it sounds like you are, then you don't have a notice of action yet. You will file everything together. DON'T file the I-130 first. You will only slow down your process.

you can't have form I-797C without filing anything. so NO, you will not be declined because you are filing CONCURRENTLY.

Adjustment of Status from H-1B, Family-Based
07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.

07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.

You'll be ok, just follow the guide and you can search the forum for anything else. I'm guessing the majority of us here didn't have an attorney and we made it, so can you. :)

Most of us have also asked our fair share of questions too, so don't be afraid to ask anything!

If my American husband fills out form G-325a about himself, what does he mark at the end of the page (near the Signature of Applicant)? Does he mark Status as Permanent Resident or Other (Specify)?

The USC should mark "other" and write "I-130"
