I mean, here's a silly question.

Let's assume for a moment that her relationship with her new person is legit.

What's keeping her from simply staying for now, unlawfully or not, and then getting married and filing a CR1 once she's is married. That should protect her from deportation right? I mean, there will be intense scrutiny of course on her. But assuming she the new relationship is real, what would be the disadvantage to that.

I think the issue there is that once she hit the 90-day mark without marriage, she MUST leave the USA. If she marries another person after the 90-day mark, she is guilty of fraud (whether it was intentional or not, it's just the law). She came with a visa and I-94 to marry ONE PERSON, and she failed to do that. She must go. Even if she got married and filed CR1, I think A) Her case would be hard to get approved since she married "the wrong guy", and 2) She would STILL be required to leave the USA until (and if) she got approved.
