Ok, so my US partner and I (Australian) are marrying in October. I am going on a tourist visa, and am willing to return home to do things the legal way. I have recently heard about k3 visas... i am not sure 100% what it's about, it's confusing me a little.. but, correct me if i am wrong but a k3 visa allows you to stay over in the US while you wait the approval of your spouse visa??

What requirements would we need for this? For one, he is unemployed at the moment and I am concerned this may be a BIG problem. He's just finished a course in Welding so fingers crossed. I am studying as well, but I am not sure what's the go with being approved for visas, and not being the wealthiest of people. We just want to be together <3

What sounds like the best option for us? Marrying October 22nd and would PREFER not to return to Australia, but WILL if it's my only option.

Forget the K3; it is obsolete. It used to be an option when the CR-1 visa took 3+ years, but now the CR-1 and K3 take the same amount of time, and in most cases, the K3 gets closed administratively at NVC stage.

You can visit during the process, but the only way to stay after the wedding is to do a K1 ahead of the wedding, and that would mean postponing the wedding as there is no way to get the visa before October.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

K3 is obsolete. Once you are already inside the USA, if you decide to marry and stay to adjust status, you may do so. However, this means you MUST NOT leave until you have advance parole, or a green card. If you do leave too soon, you won't get back in. You can also follow the CR1 visa process.
