I filed a K1 last year and was denied for not meeting the two year requirement. First we decided to re-file the K1 but after some long talking we both agreed to get married and file the K3.

I went to see my fiance last Dec and spent a week, and now I'm going down next week to get married. Now, I have read all the guides and had some basic questions but for the most part they all have been answered but one.....the burden of proof???

What exactly should I submit to show proof of relationship? And should I submit it w/the I-130 and/or I-129f packages? Or have it ready for the interview? So far I have emails (not much but a few), passport stamps, my trip last year boarding pass, phone bills (not much but a few as well), and birthday & x-mas cards. Is there anything else I should try to obtain next week? Oh yea, for out K1 we provided letters from close friends and family, should we do the same?

Also should I provide a birth cert for my future step-son? What about for my spouse?

Well for the I-130 and I-129f you only need to send the marriage certificate.

You should start gathering All of the proof of relationship, for the interview. another thing you should add to the list is Pictures, Make SURE you get lots pics of his and your family at the wedding or just in general it really helps to show the family relationship there......one of his interview questions was "who was at the wedding" ? and did you meet any of her family?

Note since you are married and are sending a copy of marriage certificate a lot of the things like proof of relationship, photos together... don't need to be submitted. You may bring those things to visa interview.

10.2)...How do I prepare the I-130 package to start the process for a K3?

A..Please see the K-3"Step-by-Step Guide". In short though you will require the following forms:

* Payment

* I-130 Petition for Immediate Relative

* G-325A Biographic Information -- 2 required. One is filled out and signed by you, the other is filled out and signed by the spouse.

* A copy of your birth certificate, passport, or Certificate of Naturalization (you have to prove you are a US Citizen).

* A certified copy of your marriage certificate.

* A photo of yourself (see note) with your name printed on the back of the photo.

* A photo of your spouse (see note) with the spouse's name printed on the back of the photo.

* A copy of the divorce decree, if you were previously married.

* A copy of the death certificate if your marriage ended due to the death of your spouse.

* A copy of the divorce decree, if your spouse was previously married.

* A copy of the death certificate if your spouse's marriage ended due to the death of their spouse.

* A check or money order for the required fee.

It would be advisable to include a cover letter explaining that the I-130 petition is being submitted with the intention of applying for a K3 visa.

One other note you may look at filing for CR-1 instead lately it seems to take a few weeks longer, but it will save you from doing AOS, in the states, get green card immediately after entering the USA.

Get as much photos and evidences as you can.

Damn. I think we may have gone overboard with our supporting evidence. I read that what was stated on the I-130 form was the MINIMUM. So we submitted photos, e-mails, phone records, boarding passes and even affidavits. Guess theres a lot to sort out in our case lol. I'm just glad we did submit it already as it was consuming our lives!!

Goodluck on the submission of your petition! It is such a relief when it's submitted. And then the waiting game begins...and this is where this board is great as the people here are wonderful and are supportive
