Sorry, one last thing, would the co-sponsor be able to use their income to qualify, provided they meet the poverty guidlines?

Of course. They fill out an I-864 just like you, the primary sponsor, does. They can qualify with income alone, assets alone or a combo of both. They just need to meet or beat the 125% requirement for their household size plus your wife.

Sorry to hear it. If you apply for an EAD without the AOS, it will expire when her I-94 does. It also takes about 3 months to get approved, so if you do the math, it is pretty much useless. I would file for unemployment and find a co-sponsor. It can be a friend, it doesn't have to be family. Good luck.

ETA: If you already made over $19,000 for this year, you might still be a suitable sponsor. The risk is if you are not, they will ask you for a co-sponsor, and give you a limited time to find one. You might send it in now (that is if you already made over the 125% poverty line) and have a co-sponsor lined up just in case.

But doesn't a co-sponsor bare the same level of financial responsibility in the event that we divorce and/if she becomes a public charge (i.e. welfare)?

Also, will unemployment benefits help to mitigate the income requirements?
