Hello there!

So super bummer. We sent the paperwork at the beginning of the month and today we got a letter saying that they need more proof of my husbands job. like a letter from the employer and payment stubs and also that we need a second sponsor because the household income is not enough.

My mother in law already offered to be a joint sponsor, the only reason we didnt filled for it at first was because we though that with my husband's job it would be enough, he makes 28.000$ a year. his mother is retired now but has a part time job with the goverment covering for people on maternity leaves and she previously worked for the goverment in a high position for 30 years so i think it should be enough.

My question is, because we have to fill another I 864 for her, do we have to pay another 420$??

Also, any recomendations as for what should we give for support evidence?

And how long will this delay the process for my work permit?

What exactly did the RFE letter say?

What is your household size? $28,000 is enough income for a household of 3, and only $800 short of the amount for a 4 person household.

It says:

1. The petitiones/sponsor's income on the federal income tax return does not meet or exceed 125% of the poverty guideline. The petitioner/sponsor lists their current income on form i864 as an amount to be considered as sufficient, however, no evidence has been submitted as proof of current income

Please submit evidence of the petitioner current income. such evidence should include

- letter of employment containing the following

-dates of employment

-nature of the job

-wages or salary earned

-number of hours per week worked

-prospects for future employment and advancement

- pay stubs for the previous six months

- evidence of other income

2. THe income did not meet 125% of the federal poverty line for the petitioner household size (which in our case is only 2)

submit evidence of assets that meet the standarts listed below or obtain joint sponsor

bank statements covering the last 12 months

evidence of ownership and value stocks, bonds

evidence of ownership of other personal property

evidence of ownership, a recent licensed appraisal or county tax assestment and any mortage or lien release of any real state

the only thing we could provide in this second part is bank statements. My husband didnt fill taxes for the past three years because he has been outside the country, and he has had this job for a month, previous thios one he han another one for a couple months. basically he has only been working since march of this year.

the only thing we could provide in this second part is bank statements. Being outside the US does not excuse a US citizen or Green Card holder from filing tax returns. If the income earned was below the filing threshold then he sponsor must supply a written affidavit explaining why. (Page 8 form instructions)

Did the US citizen petitioner supply proof of the current income claim? Typically this is an employer letter and recent paystubs as the RFE suggests. IF the annualized current income is enough ($28K exceeds the requirement) then assets shouldn't be needed.

that should be enough?

my concern is that my husband has only been working for this company for a little over a month, although is not a temporary job. is this enough or do i need a joint sponsor?? I just dont want to loose more time with this

If you submit a joint sponsor and that person isn't needed the CO will just hand back the papers. So having a joint sponsor is a great "insurance policy" if you can do it.
