Hello all.

I had applied for a K1 Visa about 2 years ago with my then fiance. SInce then, things started to get rocky, and by the time we were ready to finish up the process and get the interview scheduled, she told me that she was going back to her ex-husband. This was in July 2011. Since then, I started talking again to a wonderful woman that I had lost contact with during my engagement, and in December 2011, she came to the US to visit. After her visit, we decided to petition for a k1 Visa. I just received an RFE to explain and request a waiver since I had already have a K1 visa processed within the last two years.

My reason for cancelling the first petition is pretty self explanatory.

What are the chances if I explain what happened that our current petition may be denied or that a waiver will be granted?

Explain what happened. I think you will be OK. You need request waiver on filing limitations as required per instructions, so there is no chance if you do not request. It's not like your last fiancee arrived and you beat her... it will be fine, but if there is issue, just note there is no such limitation for spouse visa, so give it a go...

What response and explanation did you provide for Part A, Question 11 on your second Form I-129F petition application?

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)
