Hi,

My paternal uncle sponsored us in 1992. We had received application from US embassy in 2004. Finally in 2006 we got our interview date my parents, me and my younger brother. In the mean while I turned 22 and before that we keep mentioning in our letters and emails that I am getting over age please expedite our case but nothing happened. After submitting all the documents we received a letter in 2005 that I am over age and they will not consider me under the family immigration. We fought for our right and we send bunch of emails and letters to the ambassador. After sending like 15-20 emails & letters they realized that we were on the mistake and we received our interview date. Our first interview date was cancel by US embassy and after few days luckily they send us a letter with new date. After interviewing they congratulate us and we were told that we will get our passports in 8 weeks after the background check. After 8 weeks, we emailed them no reply, after several emails we got the computer generated reply that “Our case is still in administrative process.” In between we were asked for the same document 4 times Medical, police report and the application form which cost us a lot. In 2009 one of my maternal uncles (2nd sponsor) visited us in Karachi and he went to US embassy. The Visa officer told him that everything is ready but she doesn’t know why the passports were not sent. She told him submit the entire docs again, so we have submitted all the docs again and then my parents received their passports along with the visa documents. Then I emailed her couple of times she asked for my docs I did the same thing and finally I received my passport in May 2009 but the visa was issued in Dec 2008. I was still emailing her for my younger brother after few days we got an email that please do not mention any name in your emails so I stopped put her name in emails. I came to US with my parents but my parents had to go back for my younger brother. In Dec 2011 my parents went to Pakistan to visit my younger brother, unfortunately in Feb 2012 my dad passed away.me and my sister(married & US citizen) went to Pakistan and my sister went to embassy and asked for my brothers visa because we don’t want him to live in Pakistan alone whereas our whole family is in US. She told them that our dad has passed away and please we want his visa so we can take him with us. After two months we had received his passport without the visa and since then we had send couple of letters but no reply. Yesterday my uncle called to embassy and they told him that due to my dad’s death they have closed the case and will not entertain my younger brother’s case. Is this a justice??? It is very frustrating and unfair what they have done with our family. I desperately need a help please what should I do now. Thanks in advance

So let me get this right. You are now probably a US Citizen correct? I think the best alternative is to contact your local Senator and or congressmen they will be more assistance to you then a immigration lawyer. If what you are saying is true and correct and you can prove it with documentation and supporting evidence of what happend. You will have a much better case. Keep in mind many of these offices process a LOT of applications and sometimes things do tend to fall through the cracks and its not ANYONE persons fault its just the way the system is setup with flaws to cater to special cases which it seems like yours is. First get your documents together correspondance from the embassy and organize them in a proper format with a timeline which describes the events, and contact your local representative.
