Timeline

Filling out I-864. So currently I have a good job that passes the poverty level no problem. However part of 2011 I was on unemployment so my income is about 500.00 short of the minimum for (4) dependents.

I printed out my pay stubs from 6/2011- 6/2012 showing that my paystubs more than surpass the poverty level and my CURRENT ANNUAL income passes it.

For the taxes of 2011 though im just short. Do you think I still need to do a I-864a? I can add my husband as he is on the taxes, but do I need to???

Do they go by the current income or the taxes? Sounds like Current, but im afraid they might look at taxes and say no way. Advice?

Current and continuing is what is evaluated for a wage/salary earner. If you are self employed, then the 2011 form 1040, line 22 would be the income number used.

I just did my interview on June 21, and was told to return with a joint sponsor. My husband's 2011 tax returns were below the required level, so even though his current income is more than enough the IO said they focus on the income shown on the tax return. The US embassy in Kingston seems to be strict about that, so my advice: if your most recent tax return is below the required level, get a joint sponsor and let the beneficiary take that paperwork to the interview.

Okay so I was going to add my husband as the I-864a sponsor. Do they do this in combination with your income? For example, for the tax year of 2011 I was short $500.00. So, do they say lets combine the I-864a income with I-864 income and she meets requirement or does the I-864A person have to meet the 125% requirement too. (Remember, I do more than qualify from june 2011 through now because I got a job and am doing good. So I have employer letter stating my now income and also the paystubs, but the 2011 year for tax return I was layed off for 6 months so on the taxes I would be $500.00 short.)

OMG are you confused now????

HELP I have a giant headache.

Okay I think I answered my own question. The I-864 form says this:

OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here.

So sounds like combining, do you agree therefore my husbands income would be combined with mine. Although, technically on the form without I-864 a my current income surpasses it.

Im gonna send one I-864 form with myself only. Then include a second I864A and a different I864 in the package in case they need it with a letter...that way i wont have to do a RFE. What you think?

I think you should just simplify it all by using your husband as a joint sponsor. Unless there is a reason you prefer not to, of course. Complete the 864 and 864A, and you wont have to wait for an RFE. Especially since you say you filed joint taxes.

Because on the transcripts, I dont think it states who made what, and you dont need to submit W2s. If the total income on your taxes is over the poverty limit, I would just include my employment letter, and paystubs and the tax transcripts and fill out the 864EZ.

No its just 500 short on my taxes for ME only. But like I said my current income surpasses. So I put in my current income for this year on the I-864 it is way past the poverty level.
