Hi everyone! I need your advise on what to do with our case we are going to file for our 129F petition in USCIS by the way i will be bringing my son a years old with me when we have the k1 & k2 visa approved! But my question is how does my fiance a US citizen adopt my child? I mean i understand that we have 90 days to marry when me and my son arrive in the US.. my fiance wants to adopt my child so how does it work? does it occur after our marriage in the US? Please i need your thoughts on this. Thanks!

He would file adoption papers at court etc. Might be better to have a lawyer unless he knows how to do it correctly. Typically done after you get married yes.

Yes, get married first, then file the adoption paper according to state law where you live. It won;t be an immigration matter at that stage.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As the others have shared, the adoption process will proceed through the Court system following the State laws that are currently in place. Here, in Arizona they call this type of adoption a "step-parent" adoption, and they are processed through the Superior court. There is no fee and the County Attorney's office will complete all of the documents, file them and schedule your final court appearance.

One requirement in Arizona is that you have been married a minimum of three years.
