Hi guys,

I'm married to a wonderful mexican. We applied directly for the spouse visa. Packet was approved. After about 8 months, it made it to the NVC. I just paid my affidavit of support fees. Then I went and looked up the requirements for the I-864. Tax returns and proof of employment.

Well, my wife is still in Grad school working on her PhD, and I make good money, so we thought it would be great if we saved up and I came to live down here while the visa process was going and she was finishing up. Then we could move back together. I'm technically a student here, studying spanish. So, I don't have a job.

However, We have no kids, and I can prove $100,000+/yr for the past 3 years using tax returns. I have $27k in 401k (i'm young-ish), $55k in stocks and $20k in savings. Even without a job, I pay my house note, car note, property taxes, etc. on time. But, i'm currently unemployed.

I'm worried that what we thought would be a romantic and great idea, may hurt us in the long run. Will unemployment get her rejected?

When you say "came down to live here" do you mean USA or Mexico?

Unemployment won't go against you for immigration purposes. You don't need proof of employment, just proof that you have the required funds to support your spouse. If you don't have enough funds, you can use co-sponsors to meet the required funding level.

Unemployment won't go against you for immigration purposes. You don't need proof of employment, just proof that you have the required funds to support your spouse. If you don't have enough funds, you can use co-sponsors to meet the required funding level.

If you look at EZGuide on VJ, you will see that VJ members suggest to add your employment letter (i.e. a letter from your employer stating you are officially working for them till today) in your AOS package.

Sorry for the confusion. I mean down to Mexico. And thank you for that. We got really scared. We've been sort of relaxed about timing of it, because I'm here until January anyways. So, we're not concerned with speed. So, I haven't been on top of the whole process. And this sort of blind sided me. I knew i would have to prove financial supportability. So, I saved up quite a bit. But when it said proof of employment, I about had a heart attack.

And thank you very much for that link smart84! I'm pretty sure last year when I started everything, I didn't see that. That's great! But, I'm not employed by my last employer anymore. I will be when I get back to DC. But that's not for another 7 months. But I think I am going to be a little more proactive now. to avoid scares like this in the future.

No worries! I know the feeling. Other half wasn't employed when we did the I-864 stage, and also at embassy interview they asked me if he was employed, but it wasn't an issue as we'd included co-sponsors and we have some savings.

You will be qualifying based on liquid assets. Sounds like you have plenty, so as long as they are properly stated and documented, you should be OK. Study the I-864 instructions for qualifying based on assets.
