Since i'm on H1B already and authorized to work and am currently working, can i fill I765 along with my AOS application? The reason i want to is because H1B is employer dependent and if i get EAD then i can work wherever i want, not that i intend to change my job currently.

Also while filling I765 i am confused about column 16 as under eligibility criteria there are 3 parenthesis, () () (), i found out that mine would be C9, so do i leave the first one empty and fill it like () © (9). Sounds silly qn but i just wanted to clarify guys :)

Yes C9.

Yes you can apply for I-765. If you take a job on the EAD, keep in mind your H1B will be cancelled (which is okay, but to travel abroad you will need AP).

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Yes you can. You don't need I-131 (AP) if you are on H1B: it is a dual intent visa and you can travel like normal while your AOS is processing (most people cannot). However, if you void your H1B by quitting your job or taking a new job on the I-765 EAD then you will no longer have the H1B privileges (because you won't be on that visa anymore) and you will need the I-131 to travel. EAD and AP are approved at the same time, so if you take a new job on the new EAD, you will have AP by that point.
