FORT LAUDERDALE — A homeless man accused of manslaughter in the slaying of another homeless man is headed to trial this week after a Broward Circuit judge on Tuesday determined that he isn't entitled to immunity under Florida's Stand Your Ground law.

"Having considered all the testimony and the evidence, I find simply that the defendant has not met his burden here," Judge Martin J. Bidwill said of manslaughter suspect Robert Stone. "I find that he has not proved that he has immunity for his actions."

Stone, 39, a convicted felon, wanted his case dismissed before trial under Stand Your Ground — which allows people who feel threatened in the street or most other public places to use deadly force to defend themselves.

'Stand your ground' claim by Trevor Dooley in fatal park shooting rejected by judge

TAMPA — A neighbor who fatally shot a 41-year-old father on a basketball court after they argued over a skateboarder is not entitled to immunity under Florida's "stand your ground" law, a judge has ruled.

When Trevor Dooley, then 69, shot his Valrico neighbor David James in the chest in 2010, "There was no reasonable belief that deadly force was required," Hillsborough Circuit Judge Ashley Moody wrote in her order released Monday.

Although James was younger and bigger than Dooley, the judge said, testimony showed James was trying only to get Dooley's gun away.

"The court finds that Mr. James was justified in grabbing (Dooley) because defendant had reached for and pulled out a gun to confront Mr. James," Moody wrote.

Testimony. And again the problem is testimony of others. Stand your Ground and "self defense" do not apply to all cases. Obviously. Who would think they would?

Never try to get the gun away.

How about never be an a$$hole that flashes a gun at a guy you're disagreeing with over skateboarders at the park before that?

Exactly. You have to wonder what these under endowed over compensating vigilante wannabee cops are thinking sometimes.
