K1 - owning a rental property

Hi all, I am Canadian, my fiance and I have submitted the first application in March.

I'm wondering if anyone has any experience with the beneficiary owning property in the US. I own a condo in Chicago, which is currently rented out. My fiance and I may choose to live in the unit once I'm allowed to move there.

My concern is that immigration will accuse me of "living in the US" before I am allowed. I'm hoping that as long as I have a valid lease for the tenants in the condo, then I should be okay. I am also assuming they will know about the condo, even though I don't plan on advertising the information.

I also own a rental property (and my own property) in Calgary, so I have proof of residence there, and I also work in Calgary, although on a casual basis at the hospital.

Has anyone had a similar situation?

I have no personal experience but I think you can prove that you've owned the property since X and you have valid rental agreements with tenants since X. Owning US property is not illegal as long as you followed all the rules to buy and paying whatever taxes might have been required.

Just be prepared for questions

A fellow Canadian who just did her AOS last week also owned a condo in California and it wasn't any issue. You'll be fine

Cdns and other foreigners can own property in the USA legally

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
