Good afternoon. I am hoping you guys can help me clear something up that I am confused about.

On question 25 of the 864 form, it asks about my federal income tax return.

I did not file in 2011 and 2010 (the most recent ones) because I did not have any income, but I filed in 2009.

Should I check the box that says "I have a filed a Federal tax return for each of the three most recent tax years"?

I am confused because I haven't, but I think I should still enter my income for 2009...

Also, should I check the next optional checkbox for attaching a photocopy of my 2009 tax return information?

yes, you should tick the box and include a written statement why you did not file. (ie for 2010 & 2011 you did not make enough money to file).

regarding 2009, it probably doesnt matter. if you have it, you may as well show it.

21/2 - received NOA in mail for all 4 (130/485/765/131)

23/3 - biometrics scheduled -> did "early" walk-in on 21 March

06/4 - received email update, interview scheduled for 7th May

27/4 - received EAD

08/5 - email: approval one day after interview (7th May)

FOR THE AFFIDAVITE OF SUPPORT you have to show your income for the last 3 tax years. if you did not have income the last 2 years you will have to have a co-sponsor. you have to show that your spouse will not live off the government and you have the means to support your spouse if they let them come.

It states that you have filed a tax return for the previous 3 years. You did not, so do not check the box. You did not file all those years, so you cannot check the box attesting to something you did not do. Leave it unchecked and include a statement as to why you were not legally required to file those last 2 years. List the amount of income from your 2009 taxes, then on the lines for the 2010 and 2011 incomes from your tax returns, put N/A.
