If someone could please help me with some information on what I would need to do to get my girlfriend her Permanent Residence Card, she currently has a B2 Visa (Tourist Visa) which she has had for nearly 10 years. She has traveled to the US at least 10 times with this Visa. I have a Permanent Resident Card for nearly 20 years now. I want to do whatever it takes to have her come here to the US and live with me as my wife.

1 its best if u get ur citizenship then u can get married and file a i 130 it would take her 10 months to get gc and she could stay with greencard it going to take 3 to 5 years depend on what country she from and she has to go back if she stay on her visa and u have gc its a problem.@oscar

Then all you guys need to do next time she's here is get marry. Once you guys do that then you can petition AOS for her. If you guys in a hurry just get marry through the civil ceremony apply for her green card after that you guys can plan a bigger wedding.

^100% true! It will be a lot faster if you get your citizenship first !

There is no way for you to get your girlfriend a green card while she is still your girlfriend. The fastest way for her to get a green card is for you to apply first for US citizenship and then when you are a US citizen you can petition her either as your fiancee or your wife. Since you have been here for 20 years you should be able to meet the residency and physical presence requirements. Once you become a US citizen you can then sponsor your girlfriend as your fiancee, or you can get married and sponsor her as your wife. In both situations, the processing needs to be done outside of the US in her country of citizenship or residency. She may or may not be able to visit you in the US during this time,although if she has a well established history of observing immigration regulations and can provide good proof of her ties to her home country, she will more likely be allowed to visit during this process.

Only a US citizen can sponsor a fiancee. A Permanent Resident can sponsor a spouse, but the waiting time is currently several years for spouses of Permanent Residents. There is a limit on the number of spouses of permanent residents that are allowed each year and there is a waiting list. There is no limit or waiting list for spouses of US citizens and they can be processed immediately.

Regardless of what route you take you can expect it to take some time. I am not sure of the current citizenship processing times but expect they should be around 4 to 5 months from start to finish.

K-1 fiancee visas and CR-1 spousal visas are both 2 step processes. The first step is approval of your petition requesting permission for your fiancee or wife to apply for a visa. That is currently running between 5 to 8 months. The second step is the processing of the actual visa at the appropriate US consulate overseas. The processing times vary depending on the Consulate involved and can range from 3 months to a year. Each Consulate is different, but all will require medicals,security and police checks, proof of your financial ability to support a spouse, and an interview.

So, a realistic time frame if you have no immigration issues or other extenuating circumstances (medical concerns, security concerns, financial support concerns, etc.) is:

Citizenship: 5 months + K-1 or CR-1 petition: 7 months + Consulate processing: 5 months = 17 months.(This can vary by several months in either direction).

If you get married now, you can apply to sponsor your wife by filing an I-130 petition, but as I said, there is a waiting list for spouses of permanent residents so it will be a few years before her place in line becomes current. She would not be allowed to remain in the US with you during this time, and if she did, then she would not be eligible to adjust status when she overstays her visitors visa and is out of status. Plus, if she is in the US without status for 180 days, then when she leaves the US and tries to return she would face a 3 year automatic ban (10 years if she has more than 360 days out of status).

Only US citizens may petition for fiances. You would need to get married and follow certain guidelines. Below are links with information regarding individuals that PRs or USCs may pettiton.
