I want to know if my wife federal income tax REFUND

is included with her TOTAL GROSS INCOME FOR THE YEAR

tax refund

Simply, is Tax refund can be adding with the income for meeting The Poverty guidelines ?

10/13/2011 (Day ***) Received RFE-- Requesting that I provide documentation to prove I was never married in Uk or Illin
02/11/2012 (Day ***) Service request..Told its being reviewed by supervisor

24th March 2012!!!!!!!!!!! Email notifiying me of CARD IN PRODUCTION
03/26/2012 (Day 376) Emails confirming that my I-130 and I-485 have been approved.

4/2/2012 Green Card In Hand!

Unbelievable that my journey took this long but Im thankful

Next Stop Premed...Yup!

3/24/2014 Application for conditions to be removed

9/22/2014 APPROVED without interview.

no it's not included as gross income, but when the check is deposited in the bank account it will appear in the total of deposits of the year,and it will be good for her :thumbs:

Correct. A refund is just getting back money that was already earned and therefore cannot be included in gross income.

She can make up the difference with assets, if she owns a home, has at least two cars, has significant savings, etcetera. Does she get child support income? She has to make up the difference somehow. Her tax refund will never be considered as income.

Thank you for your input 'Golden Gate' but she only has one car! and not owning a house! but i do here in morocco, Can we add the value of my house to help us to meet the requirements ?? No she dose not get any child support income!!

I'm not sure if it's appropriate to inform us all of your wife's income. I know I'd be pretty upset if my husband posted my numbers on VJ. My advice would be to be careful about divulging too much information on an internet forum. Proper advice was given prior to your posting of this info. The exact numbers were not needed.

Ask a moderator. And think twice before you post something, it's pretty clear your initial judgment doesn't serve you too well.

Federal tax refunds cannot be added to your wife's income because it is already accounted for because it is part of her gross income from that tax year.

For example;

Wife earns $30,000 (her gross income). From that $30,000, she pays $5000 in taxes through her employer and gets paychecks for $25,000. She owes $2000 in taxes. She gets a $3000 refund.

On the I-864, she reports her gross income. Her gross income is $30,000. If you add her tax refund to the $30,000, then you would end up counting it twice - once from the $30,000 and again when she overpays her taxes from that $30,000 and gets a partial refund of that $30,000.

Let's use an extreme example;

Wife earns $30,000 (her gross income). From that $30,000, she pays $30,000 in taxes through her employer and gets paychecks for $0. She owes $2000 in taxes. She gets a $27,000 refund. Her annual gross income is $30,000. Her gross income is not $30,000 + $27,000 refund = $57,000. Ridiculous result.

Honestly, I am not sure about including your house. Look on the I-864 form for what you can include.
