We got placed on Administrative Review... WTF!!! What to expect???

went to the interview with my fiancee today. We waited forever and was handed a sheet stating that our case was on administrative review and to wait to hear from the US Embassy! No missing documents or anything.

During the interview with the CO, she had mentioned that she was looking for some security document or something that she can't find. Then when I spoke to Windows 38 the lady said that they are needing some security docummentation of investigation on us. What the heck does that mean? I have been asia to see my fiancee 6 times in under a year and I was at the interview for crying out loud.

What can I expect from this process??? Is this a preset for a denial? What can I do to get pass this process? Can my Senator assist still? Please help! I'm so desperate and pissed!

Has anyone been in the same situation? What was done and how long did the process take?

Sounds like the documents got misplaced from when USCIS did the background check on you and your fiancee so they need to find them or worse... replace them.

How long you will have to wait seems to depends on when they find/get those documents. Once they have those "security documents" all should be fine.

Doubt if calling your senator will help, unless he knows where those documents are...

sorry to hear that,it's really sad that you flew all the way here and didn't expect all this thing happen.If they didn't return your passport i guess there's a chance for you to be approved.but it will take weeks as they do investigation...Keep on Praying...

Sept.25 USPS pick up mail from USCIS(EAD card on the way!)

Sept.27 EAD card received.

Sept 28 went to SSOffice for name change on SSN card.

Oct 05'12 Got my new SSN card.

April 16'13 USCIS emailed Case Status:Card/Document Production.

April 20'13 Recieved mail from USCIS welcome notice.

April 22'13 USCIS email that USPS picked up mail containing my GC.

April 25'13 Green Card on hand,finally!...

I agree here, calling a congresscritter will do zero good. Congressmen have zero sway at the consular level.

Sorry to hear you are in AP. This is the part that sucks big time. As you can only wait until they find the missing documents from USCIS. This can take weeks or sometimes months. You can call DOS and USCIS to inquire about your case. Other than that its a waiting game.

I know this is not the outcome you wanted and definitively not your fault. This is one of the many problems in this process. If USCIS, NVC or Embassy does something wrong (ie missing documents). The petitioner and beneficiary suffer the pain of waiting even more time.

Trust me I went through a similar issue with my case being sent from USCIS to NVC. Normally an approved case is sent from USCIS to NVC within 5 - 14 business days. Ours took 59 days to get to NVC from USCIS. I called DOS, NVC, USCIS. All fed me the scripted bull. Then they received our petition and put the wrong birthday for my wife. Thats when I got level 10 and went off. It took 3 days extra for them to correct there mistake.

So I hope and pray your AP is processed expeditiously in your case.

I went back to US Citizen services and they were zero help. I went and hand wrote the Immigration service a letter. This is friggin ridiculous!!! I am beyond pissed!!!

Breathe breathe.. Your are wasting your energy and time going full speed with anger over this part of the process. You find will others that went through your situation. This is a case of the right hand not knowing what the left hand's doing.

Calling USCIS will only get you no where. They will not drop what they are do on a daily basis for one complaint about being turn away due to a misunderstanding of documents requirements for a medical in a foreign country. Writing USCIS will do nothing either. Like I said before it will be noted and filed. That's it!!

Keep the focus on getting through the process. Double check that she has all the required documents for SLEC medical. Call ST. LUKE'S MEDICAL CENTER EXTENSION CLINIC. Verify the requirements with them. Have her print out the St. Luke's requirements page. Send her back to SLEC. When she gets there, if the same security guard is there. Have her present all documents with the St. Luke's requirements page.

If the guard still gives her issues. Request to speak with a supervisor at the hospital.

So sorry to hear that. Puzzles me that they don't just tell you what it is they are looking for or can't find, or whatever. I mean, why can't they just say for example - "We are having trouble finding the results of the background check of the petitioner (or whatever the case may be). We will contact you when we find them. In case we do not find them we will need to run the check again..etc."? If they now what it is they need or are missing or whatever then why not just tell the couple (in this case) or the beneficiary that and then set an expectation for them and arrange some kind of follow up? Cripe, how hard is that? To purposley leave the couples dangling in the wind like this especially at this stage of the process, just seems purposley and inhumanely cruel.

Basically they are saying "We know you've ben through a lot in this process already and we don't give a #######! Now you're in Administrative Review and we still don't give a #######. AND we will not tell you why and we give even less of a ####### about that! SEE-Ya! Oh, and don't call us, we'll call you!"

Oh well, hang in there!

It may be a simple problem...sometimes the consular officer or the case worker loses documents. That's what happened to us.

Four days after her interview, Chinook received a phone call from an Embassy caseworker. He said that he "misplaced" my I-134, income tax returns, W-2's, and employer's letter. He asked Chinook to submit those documents again. Fortunately, Chinook was still in Manila and she submitted copies that same day, so her visa was not delayed too much.

I hope your case is not delayed a week or two while they look for the document they need. Hang in there. :thumbs:

i notice on your timeline that you have 2 denials from uscis, maybe thats the reason why the embassy was strict and making sure the papers are complete.

have patience.. goodluck.

Those were expedite denials.

What gets me is that the Consular officer went through the paper works about 3 times and looked as though she was really looking for something. She mentioned missing a security document. When we were given the for stating to wait, the Filipina at the window was extremely unsympathetic and was such as smart ####! The same with the lady on Window 38 when she told me that the delay was caused by me due to some investigation that needs to be done on me. What gets me is that this so called investigation or security check was already done by the USCIS, from my understanding and was supposed to have been sent to Manila along with the rest of our file. They for whatever reason misplaced my security check and all these people at the embassy were acting like I was a friggin criminal that needed additional scrutinity in my background.

I'm extremely upset still and broken hearted. I haven't slept and when I did, I woke feeling like my heart was about to explode and I was right next to the woman I love. These people at the Immigration, don't get what people like us go through. The sacrifice, they have no idea what its like to put your lives on hold, the cost involved noth monetary and emotionally.

We are both at a loss. My fiancee is being very strong, I'm so proud of her but I know she's just putting up a front so I won't get too depressed.

I wish they had at least told us what we need to do as oppoed to just saying wait. I have heard people waiting from a few days to about 10 months. If it's going to take us that long, we might as well just get married and apply for a CR1.

do you have any record or anything that you did in the past that you didnt tell them or your fiancee?

nope! Abso;utely not. if it was about any sort of red flag it should have been addressed during the adjudication process. plus the CO did say she cant find mya securitydocument not hey you look like a criminal so i need to request one.
