Guys plz help i need your advice!!

My husband did his citizenship test on March 26,2012 the IO gave him a paper stating s he pass the english and civic test but they requested a copy of his tax return from the IRS for year 2006-2008. We called IRS that same day and order them they said it would take 5-10days. Well we got it on April 2,2012 but all we got was 2008 with a letter stating they only go 3years back so they can not send us a copy of the previous years.

My question is should we send the exact things that IRS sent to us because every number we have for IRS is an automated operator so we can not get to speak to any1 and my husband has until April 15 to bring in the evidence they had ask him for.

You can try to submit what you were given by the IRS along with a statement indicating what they said the policy is. You can also go to any IRS office to request help.

Ha, and my wife was chewed out for bringing in four years of tax returns, ONLY THREE YEARS ARE REQUIRED! But I tossed in that fourth year as a subtle means of telling the USCIS they are extremely slow.

If you didn't have your 2011 return, could only go back as far as the 2008 tax year. According to IRS regulations, you are suppose to keep your tax returns for the last three prior years. But if called in for an audit, will go back five years. So how come you didn't keep your copies?

Feel your husband's IO is going overboard on this subject, seem to be running into lot of this lately. Can contact your senators office and have that decision reversed.

Said this a million times before, with practically any government agency that certifies, you meet with a board with a vote, and always one guy that always votes no, but is in the minority. With the USCIS, you are just dealing with that one guy. That isn't right. And they make up their own laws as they go along.

Do you not have copies of your returns? THis is like the first rule of filing taxes... keep copies! If not, just do as all others advised and see how that goes.

We faced something similar when my husband's naturalization was in process. See, if you want trasncripts that go beyond three years, you have to request for an ACCOUNT transcript through the IRS toll-free service. For the immediately preceding three years, you can request RETURN transcripts. They are normally available for the period that you require them,

As you go through the prompts at the IRS toll-free number, it gives you the options, so if you are requesting for 2006, please ask for RETURN transcripts for that particular year.

That is how we dealt with this situation. Hope this helps!

The Journey

Arrived on F1 visa on 25 Dec 2008. Graduated June 2011. Started OPT Sep 2011.

Exactly three months from start to finish,no RFEs.

Well idk but they said they want it from IRS not from the company my husband used to do his tax. My husband was unemployed from 2008-2010 so thats the reason why i think they ask for 2006-2008 but idk i am so confused because we are waiting on his citizenship then send in my papers so this situation makes everything on pause for us :help::bonk:

You must have ordered a RETURN TRANSCRIPT. Please go back to the IRS number and order for an ACCOUNT TRANSCRIPT for the years that you are missing. It is totally free and comes within about a week to ten days. Lots of people have faced this problem. We did too.

Are you talking with a human or the machine? I had so many problems with their automated system. Talk to a real person, I was able to order transcripts for the past 5 tax returns.

Also maybe you can try the online ordering system - http://www.irs.gov/individuals/article/0,,id=232168,00.html

Good luck.
