RFE but still got email saying I-130 got approved!

Hi all VJrs!

My hubby and I are a bit confused. We have received two RFE's. The first one came on the 14th of February - talk about ruining the mood on Valentines day... ;( It was requesting a Marriage Certificate. But we had sent in the document equal to that, since Sweden doesn't have specific Marriage certificates. So after this, I got a hold of two more documents that state that we are married and that the government has registered it. We sent in our respond. And on the 20th of March we got another RFE, requesting the same thing! Hubbs called USCIS asking what document they want since we have given them all the ones we could possibly think of. The guy he got to talk to said that we needed a document from either the government or the wedding officiant stating that Sweden doesn't have specific Marriage Certificates. So I got the wedding officiant to write one for us and sent it off to my husband. The same day he received my mail he also received two emails (I-130 & I-129F) from USCIS saying:

Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

On March 30, 2012, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

"

Is this even possible??? That they approve a petition while they have sent out an RFE? Could it have anything to do with the phone call?

Still waiting to see if there comes a NOA2 in the mail, but just thought we could ask you guys meanwhile :)

12/09/2010: He proposed and I said yes!

05/21/2011: Married the man of my dreams :)

USCIS (252 days)

07/18/2011: Sent I-130

07/22/2011: NOA1

02/14/2012: RFE

03/09/2012: Sent reply to RFE

03/20/2012: RFE for same thing

03/30/2012: NOA2 email (approved 1 week after phone call to USCIS, the right documents were there all along)

04/03/2012: NOA2 Received hard copy

NVC (26 days)

04/09/2012: Case Number assigned

04/11/2012: AOS invoiced & paid

04/11/2012: DS-3032 Sent by email

04/18/2012: Received email, approved DS-3032

04/21/2012: Sent AOS-package

04/22/2012: IV invoiced (said the 19th on it??) & paid

04/24/2012: Sent IV-package

05/06/2012: Case complete

06/07/2012: Email from NVC with interview date!

06/14/2012: Medical in Stockholm

07/10/2012: Interview in Stockholm

Look on the USCIS web site and see if it shows approved. It could be someone finally looked closer or bothered to look up marriage customs in Sweden. I wouldn't ignore the RFE, unless I had the actual approval letter and not just the email in hand.

Somebody senior who knows about Swedish marriage certificates overruled the junior person who issued the RFE. No worries.

Facts are cheap...knowing how to use them is precious...
