I think when you are almost 10 months into your visa journey, and you hear it will be more time, your heart just sinks. After our RFE, USCIS went past there allotted time. Called USCIS they put in a service request to the service center working on our petition. Friday I get a email, stating that our case is pending background checks and can take up to 160 days more. Wow.... I am hoping that background checks now and we are cleared means that it will be an easier AP for my husband. In October we will be married for 2 years. I think it is most defiantly time to call my senator, maybe it will help us along. Anyone else dealt with this and did it turn out ok in the end!!!!

This is where the journey gets tough. It feels lonely on this road. I can tell you what it feels like because it was me up ahead of you & there are others behind us.

In my case we got almost zero information as we went along so you are lucky to have some idea of whats going on. We sent 9 letters. Heard absolutley nothing back. My husband had 4 meetings with USCIS in two states where he was told " this just never happens". Yet it did & does.

He tried to get help from a U S Senator as you may. That produced nothing. It took a month to be told what we already knew.

Dont bother calling your politician. Send them the form for their web site or they wont even begin. You will then find they get back to you with usless info but you will feel you did all you could so it does help.

Turn out ok? Yes. After 408 days I we issued my visa. An RFE cost us 60 days of that so we paid for our mistake. Whatever price we had to pay to be given the privilage of emigrating to the USA was worth it.

You will see soon that your investment will pay off.

What was your RFE for?

Everything will be ok.

Don't ever do anything you're not willing to explain the paramedics.

Yes

fax the congressman and state you would appreciate a congressional inquiry.

If u are having issues at this stage then they probably will continue through your journey.

So, get the congressional inquiry now and have his name on your file for the rest of the process

and that will help you in the long run

I have seen this happen a few times

and mostly the people know the red flags in the relationship...and uscis drags it out for quite awhile

and sends a 4 page RFE. This is a big clue that they have doubts of the mans true intentions.

Sometimes he is talking with other women. The USCIS is there to protect us. And they make us jump through some pretty big hoops to get what we want.

Usually it is an age gap of more than 15 yrs

or the man from the middle east has had previous girlfriends from america or previous attempts to immigrate

and quite a few other red flags

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

We went through a lengthy name check before the I-130 was approved in addition to an interview at our local USCIS office. The I-130 was filed in February 2003 and was approved(finally) in July 2005. So...about 2.5 years. The good news is that name checks, background checks, or other random AP don't take nearly as long now as they did then. It was very common at that time for name checks to take 4 or more years.

It'll just take a little longer than normal, but you'll be fine in the end.

It'll just take a little longer than normal, but you'll be fine in the end.

Thanks so much.. it is just so frustrating. I rather be going through the background checks now, then with the Embasy doing them. The Embassy is so busy, I know some get lost in the suffle. I am encouraged by your words and glad you everything worked out for you.

I have no idea what the RFE was really for. But it was at the USCIS level and it was the basic bonafide marriage 3 page RFE. Which I hear is pretty common. Most people only have 30 days they gave us over 2 months. I thought it was kinda weird.

What was your RFE for?

I did hear that most RFE's have background cheks at the USCIS level. And the process gets easier after that approval.

We went through a lengthy name check before the I-130 was approved in addition to an interview at our local USCIS office. The I-130 was filed in February 2003 and was approved(finally) in July 2005. The plus side is if he enters the US after you have been married for 2 yrs means he should get the 10 yr greencard...but really I hope he will be here before that.
