I have filed the I-130 for both of my step kids in September. It hasn't been approved yet should be any week now. My wife has been in the US for about more than a year. We had to leave the kids in Colombia with the grandmother in till the children's custody was ruled on. My question is the whole process is like my wife's, or since the Biological parent is living in the US there's something different? I was reading a guide and I came onto following-to-join benefits which confused me.

well, you could have asked for an expedite when ya filed the I-130s,(via a letter included with the I-130s) as the mother being in the USA actually is one of those qualifying thingies for reason of expedite.

You might want to call up to USCIS on Tuesday, get an ISO and inquire for 'expedite intake process' ..

or wait it out another month or two.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

James Mario,

The expedite may or may not work with the USCIS and/or with the NVC, but it doesn't hurt to ask.

As for the process, it shouldn't be any different from your wife's.

There is also a Colombia Club thread in the Latin American forum where you may be able to find additional info regarding their visas and the process in Colombia. Please feel free to post there if you find it useful.
