This is from the VisaJourney FAQ regarding DCF's...

In this circumstance, the U.S. citizen marries the foreign fiance (either in the foreign fiance's country, in the US, or in a third country...the location does not matter as long as it is a legal marriage) and applies DIRECTLY through the foreign U.S. consulate for the spousal visa.

Can the DCF's be done in the US or not???

And???

The marriage can take place at any location. The DCF has to be done at the consulate you trust (abroad)!

You highlighted the part. Have a close look.

No, Direct Consular Filing takes place in Consulates (or Embassies) which are located outside their host country.

Example: my husband lived in Greece, I went there, we married and I filed my peition for him at the Embassy in Athens. He was then invited to apply for a visa.

The process for inside the US is different.

if we had VisaJourney I probably would not of hired an attorney for the K1.

The quickest way is to get your K1. I think it is a 9 month process and under a thousand dollars in fees. Being that you have spent time together, it should be no problem proving the relationship.

If your job is not UK dependent and the company is going to continue to pay you into your UK account. I would not worry about it, being that you are not technically working in the US, you are on the internet. I know alot of people will probably dissagree, but if you are paying the UK taxes and it is income from the UK, then it has no real relevance here. I justify it this way, if you were on vacation here, and they needed something done, if you performed that work and were paid into your UK account, then it would not affect your stay.

Thank you everyone for your advice.

My heart has sunk.

I am only concerned with being with my Natalie regardless of location. But her life and career are in LA, and I think the UK would offer her very little. In my mind we where already living together.

DCF’s are clearer to me now – and not an option. I want to do this legit. This, I do not want to mess-up.

VisaPlus warnings have been heeded – thank you. I actually had no intention of using their services after I gave away my 99 quid.

I'm really sorry for your disappointment, I can feel it from here.

You may have more options getting there on your own, depending on your profession and employer. Have a read of these ideas and see if anything looks possible: http://britishexpats.com/forum/showthread.php?t=330696

Remember that you don't necessarily have to find an option that converts to Permanent Residency. You need to find a way to legally live and work in the US in the short term. Don't be afraid to investigate H-2B or J visas if they serve your purpose. Another option is going back to school, altho you are very limited in the work you can do.

You answered your own question:

...not in the US.

I also just wanted to correct an earlier comment by Stinger157:

DCF is, at least in germany, only possible, if both partners have their residence in germany. I am not sure how much the consulates and embassy in the UK vary.

That's not true, I am not resident in Germany and my husband filed DCF for me here. Not that it has any relevance to this thread, but just throwing that in there :)
