Why do you want to get married and live apart? Most people get married because they want to live together.

If she is from South Korea you can get married while she is visiting (VWP) and she can go back. You don't need the visa for permission to get married. The K-1 visa is for permission to enter the country with the intent to marry and live there.

I'll be calling the USCIS office about my situation and see what they have to say about it, and if it is looked down upon to get a K1, marry in the US, leave the country right away before the AoS/AP, and then filing for a K3 visa... for some reason I think they might not like it?

The K-3 is no longer an option. If she leaves before AOS/AP, you would have to file an I-130 petition to enable her to re-enter the US. Without that, she will be denied entry.

Why do you want to get married and live apart? Most people get married because they want to live together.

If she is from South Korea you can get married while she is visiting (VWP) and she can go back. You don't need the visa for permission to get married. The K-1 visa is for permission to enter the country with the intent to marry and live there.

She went through the Visa Waiver Program, and, upon arrival at the airport, she got interrogated for half an hour and I was also called to verify who she was, her intent here, how we met, etc. She said she was visiting friends, but did not mention she had a boyfriend at the time. So they called her in for interrogation, and dumped out her things and found a picture of us, and got mad she didn't say that I was her boyfriend. We were both more or less lectured that by no means was she allowed to get married on the tourist visa she used. They told her they'd be watching her, but let her into the US. I felt very bad she had to go through that. So I'm not sure we can get married on a VWP here. (Maybe I'm wrong and the interrogator was just trying to scare us?)

We don't want to be apart either, but because of her work projects she has to finish, she can't stay here until it is complete. I also just started a job after a 2 year study abroad time in Korea as well as a year of looking for work, freelancing, and some travel. Thankfully, my job is letting me travel there for 2-3 months for the ceremony there, but I don't want to up and quit so soon after since I need to be earning money to support us in the future. So, unfortunately, right now we're both kind of bound by our jobs...

In an international relationship you can't have everything you want. You can't get married in every country in the world and hop around and work wherever you want. I think you have to make some choices. What is really important to you? This all just seems like a lot of nonsense.... and she lied at POE... not wise. Good luck to you.
