Just wanted to advised all on something i didnt even know until i was denied.....if u are denied u have the right to appeal the same day at window 26 or 27 before ur case is sent back to uscis for them to reconsidered your case to be reopen, but you have to summit a letter stating everything on your interview there is a great lawyer by the name of Marisol Acosta that has an office 2 blocks from the embassy that will prepare a letter for you to take to the general consul. She did it for us the day after our interview and summited it via email and personally at the embassy and i have to say that the consul responded back via email to my lawyer in friday March 9 advising to her that he will review our case before it is sent back to uscis, so now i have hope. it cost me not even 120 dolares and its worth it. So to all upcoming interviews there is hope if u get denied and there are options, so make sure u visit her office before coming back to NY its worth a try.......:)

Any idea how long the review will take. Thanks for the info on the lawyer. I'm wondering if it would be good to have one of these letters with me when I go to my wifes interview. Can you possibly put up a copy of the letter or basically what it says? Thanks

May I ask what the reason was for denial?

we wer denied for 2 sections 1st material misrepresentation and second divorced to remarry for immigration purposes.

but they just assume that without asking me for proof.

Also i would like to say that i called the Vs and they advised to me that my case is now under AP hoping that the letter my lawyer prepared made them reconsidered there decesion so i am happy that i am under AP and nothing as of denied in there system. Hoping they just reopen my case or just approve my husband because God knows wh love eachother and are in this for love and not for immigration purposes

hey batista....question when you stated that the second reason was for divorce for immigration purposes what does that mean?... I was previously married to my ex husband who came to the states on an educational visa and after getting married we filed for his paperwork so they would not deport him but the marriage didnt last long. I filed for divorce in dec 2010 and it was settled by 4/11 and I then filed for my new fiance whom is also from d.r in october...6 months after my divorce went thru. He lives in D.R will this be a problem? We have a baby together as well.

To tell u the truth if u guys didnt have a child together it would have been a problem because this is whats happening with me and my husband only difference we dont have kids together. i was pregnant and lost my baby Jan 30, 2012 at 8 months heart stop. But maybe they will ask u guys for a dna which cost 480 dolares maybe they wont ask for it but for them if u were married before and divorced and remarried for them thats a red flag. wish u the best of luck...

Neoflaher for that letter u have to wait after ur interview because if they dont ask u for proof or send u to window 11 u have the right to appeal before ur case is sent back to uscis

ok so would it be smart to get the dna done before we go to our appt or after they send us?? I new this would be a red flag but since there's nothing to hide I said the hell with it I am gonna to try any way lol. Thanks I guess I am really gonna need the luck.....wish it wasnt so hard the past cant be fixed or changed ;-(

And sorry about the baby I would have been devastated I cant imagine!

no they wont accept dna from here it will have to be done over there but thats if you get a consul that is mean because if not just with the baby Bc is good enough all i wanna tell u is that if u dont know an answer just say im not sure dont try to guess and also if u guys have kids before u married make sure u guys know the father name or mother and also if they pay child support because that was 2 of the questions they asked and i wish u luck and keep me posted :)
