I'm new to visajourney.com and found some very useful information here. I'm ready to start filing for a K1. But I have a few concerns first....

My fiance is from the Philippines. She was raised by her grandparents, therefore, her grandparents names are listed on her birth certificate. They have passed away years ago. She never knew her real father, and she now lives with mother and step-father. She is 22 years old. My questions are...

What names do I list as her parents on the I129F?

Are the names on her birth certificate going to be a problem at her interview if they are difference then her BC?

Any other problems I should be worried about with this issue?

You list the names that are on the CERTIFIED copy of her birth certificate that she needs to get from NSO. Not a bad idea to have her request that now as it will answer your questions and she will need copies later. Order a few extra as they always will come in handy

Fix the birth certificate.

First, it's never wise to provide documents with false information. It's false information to list her grandparents as her parents. It might even be illegal to submit documents with falsified information.

Second, she will find it impossible to "fix" if she later petitions for her mom.

I just noticed that the I-129F form does not ask for fiancee parents information. Only on the G-325A form. And she receieved a passport using her birth certificate. So I don't see it being a problem by listing her real parents on the G-325A. Thanks.

I would put on the G-325A the name of her mother. When it is time for the interview, bring a document describing the situation and have the mother sign it explaining why the birth certificate has her grandparents names instead of her mother.

10/28/2011 - Texas received/Check Cashed

11/01/2011 - NOA1 (6 days after mailing)

03/22/2012 - NOA2 (142 days after NOA1)

04/20/2012 - Received Interview Date (June 4th)

05/22/2012 - Medisys Medical(Done!)

06/04/2012 - Interview in MTL (APPROVED!)

Have her go to NSO and get her certified birth certificate, then you will KNOW. You are going to need to have that eventually anyway so you are not nothing and may be avoiding an issue later. Heck you can do it online or by phone and they will deliver it.
