I'm not even really at this point yet. I'm just about to send off my I-130 packet but I'm trying to stay ahead of the game. I was wondering can a trust act as a sponsor? I am living in Japan and will be quitting my job and starting from scratch back home in August. I can't act as a sole sponsor but my parents might be able to help. they don't have an income, but they have a few assets. The only problem is a lot of their assets aren't under their names but under the trust. Could we use anything tied to the trust?

Study the I-864 instructions on this carefully. I expect that assets not in their own name would surely not be considered "liquid" by the definition used. Perhaps your parents have sufficient liquid assets to qualify as sponsors. If so, focus on those assets.

A sponsor must be over age 18 and be either a US citizen or LPR.

A trust can not be a sponsor because it can not meet the requirement above.

If the assets are in a revocable living trust, your parents would treat the trust assets as their own on the I-864.

Ok! Thank you so much, that answered the question. I guess we'll focus on assets in their name.

Study the section of the I-864 that covers how to use assets. I find it difficult to believe they have ZERO income showing on line 22 of their tax return though unless it's because they are taking losses on investments or business. Even so, there's some number there. If it's a negative number, then the income shortfall will be the full amount of income needed PLUS the negative number on line 22. Need $5 in assets for each $1 in income shortfall.
