Hello VJ's

How long will it take for my husband to get his IRS ( Internal Revenue Service ) for his I-864. The NVC requires him to submit that paper before they consider my papers complete,(that's the only missing part of the NVC process).

OR

Will the NVC forward my papers to US Embassy Manila even we haven't submit the IRS yet?

PLEASE HELP PO!! Thanks

Please make a Timeline.

The NVC will not do anything. The Embassy in Manila will rely on you to show proof of his Tax Returns

NVC cant forward papers that dont exist. They don't do that anyway.

Are you talking about the tax transcript for the previous years or the 1040 for this year?

If he ordered the tax transcript from IRS he should be able to get it in 5-10 business days. :thumbs:

Did NVC approved the I-864? Coz sometimes they approve the I-864 even without the Transcript and send the case to US EMBASSY IN MANILA but they will add the Transcript on the checklist and you need to show it to the CO during the interview. I checked your timeline and you dont have one, did you sent the DS 230 already?

Did NVC approved the I-864? Yes, they are asking for the transcript. We already sent the DS 230 and the other required papers. It's just lately that they asked for the IRS transcript of my husband. They said that he need to submit that paper before they continue the process....why do you think po?

It only takes 5-7 days to get the transcript and its free. What did your husband sent together with the I-864? Did he sent the w2 and income tax return for the past 3 years?

It only takes 5-7 days to get the transcript and its free. What did your husband sent together with the I-864? Did he sent the w2 and income tax return for the past 3 years?

Before my husband sent the I-864, he called and talked to a person from the NVC. She told him that W2 and Certificate of Employment are enough to go along with his I864. After they received it, they said that changes were made in the requirement and he need to add the IRS transcript...hayyys.

Really thats what the operator said? OMG the operator messed up on that one :bonk: I believe since then the instruction was W2 + 1040 (Federal Income Tax Return) tax transcript is optional if you sent both W2 and 1040.

That memorandum was sent out in 2006. It's not a recent change, and it's not specifically about the question you originally asked. Prior to 2006, USCIS and NVC were requiring complete tax returns or IRS transcripts for the prior three tax years. That memorandum states that only the most recent tax year's return or transcript is required, but that additional returns or transcripts can be submitted voluntarily by the sponsor, or requested by the immigration officer.

A W2 has never, by itself, been sufficient. A W2 is a form provided to an employee by their employer that states how much they were paid for the year, how much was withheld for taxes, etc. The W2 is used by the employee to prepare their tax return, and a copy of the W2 is submitted with the tax return unless the return is filed electronically.

What the government wants is evidence that a tax return was actually filed, and they can't get that evidence directly from the IRS. That's because US law makes the IRS almost entirely autonomous, and not subject to the overlapping authority of any other US government agency or political body. The purpose of this is to prevent the IRS from being used for political purposes. For example, a senator can't order the IRS to overlook a tax liability for a corporation without the legislative and executive branches passing a law for that purpose. The net result is that USCIS and Department of State only have access to IRS records that are public, such as tax liens. They don't have access to individual tax records through the IRS. They require the sponsor to prove that they filed a tax return for the most recent tax year. A W2 alone is not proof.

He can go to any local IRS office and have them print a copy of his tax transcripts for any year desired.

Then why do they even allow you to send three rather than one? Making sure you filed is not important. Income is! That is what the entire 864 process is based upon; income level. I submitted two 1040 (2011 and 2010), 6 years of W2s, 5 months of pay stubs and letter of employment. Edited by extremerecluse
