Hello Everyone, :yes:

Been a while since my last post. Hoa and I have been talking alot and I have my flight to Vietnam coming up on March 23rd. We are very excited to finally be able to get together and after all the time talking I have proposed to her and asked her to marry me. :D I am overjoyed that she has accepted and once I am in VN we plan on having the engagement party :dancing: . It is important for me that she and her family are happy and I want to include her family and friends as much as we can. So given the timing and my availability from work, we are wondering if it is best to pursue the k-1 visa or marry once I am in Vietnam and pursue the k-3 visa at that point. Would it go bad if we have the engagement party and we marry in 1 week during my trip to VN?

Go for K1, K3 is nothing it will just make the I-130 process longer or make you wait longer.

USCIS Stage

July 11 2011: Mailed from APO, AP address

July 16 2011: Delivered in Chicago Lock Box Facility

July 18 2011: Received notification via email with the receipt number NOA 1

July 25 2011: Received NOA1 (hard copy)

August 1 2011: Touched

February 16 2012: Approved!!!! (Received E-Mail from USCIS) NOA 2

It took 213 days before we got our NOA 2

NVC Stage

February 24 2012: NVC received the documents from USCIS

February 24 2012: Sent an email to NVC regarding DS 3032 (Assign an Agent)

February 27 2012: Case number assigned by National Visa Center

February 28 2012: Received an email from NVC telling me that they already received my DS 3032 (Assign an Agent) Now waiting for IIN

February 28 2012: Called NVC and I got my Invoice ID number, they told me to wait for the email before I can pay for it

February 29 2012: Received I-864/DS230 Invoice via E-Mail

February 29 2012: Paid I-864/IN PROCESS

February 29 2012: I-864 mailed from APO address (overseas)

March 1 2012: I-864 showing as PAID on the website

March 5 2012: I-864 Delivered at NVC (Portsmouth, NH)

March 8 2012: I-864 Approved!

April 8 2012: Sent DS 230

April 13 2012: Paid IV Bill (IN PROCESS)/NVC Received DS 230

April 17 2012: IV Bill showing as Paid on the website

May 3 2012: Case Completed (Interview date scheduled for 8th June 2012)

June 8 2012: Interview APPROVED!

Basicly here is the situation, Like many of you We feel we are caught betwee our families and the Visa procedure just because we love each other and want to be together. Being a father I understand each family wanting to be at the wedding and I would be a hartless husband if I denied either family that right due to the K-1 or K-3 process. Her family is unable to travel to the USA for a wedding and my family is unable to travel to VN for a wedding.

Hoa and I know what we want for each other and we know how we feel for each other. So in trying to make sure both famlies are able to be a part of a wedding we are going to have a wedding in VN and one in the USA. If a K-1 is best for us the wedding in VN will be "unofficial" and we will make sure not to have any marriage license ect.. this way we still hopefully quallify for the K-1. If the K-3 would be better then the marriage in VN would be "official" and we would have a second wedding in the US for my family. The main question is would the wedding in VN "unofficial" or "official" hinder us, and what would be the best way to procede?

You can hold an engagement ceremony (Đám Hỏi) and invite family, friends who are dear to her and her parents. Đám Hỏi has a special and important place in most if not all Vietnamese marriages. On the other note, my cousin held small wedding receptions in both Vietnam and the USA so those who couldn't travel were able to attend.

Your first trip to Vietnam? Don't necessarily have to have the Engagement party 1st trip. I did k1, fiancee here in 10 months, 2 trips made to Vietnam. file the K1 when you get back and mention in the Timeline that you will make a 2nd trip to do the engagement, it could possibly help your case if you wait on the Engagement, either way make sure your paperwork is in check and lots of evidence. Having the engagement party and then the wedding within a week could be a red flag. We went that route and it caused us problems. IMO, I would go the K-1 route. The K-3 wont speed things up in getting her to the USA. If you marry the I-130 is the way to go.

Like Sayha said, a consultation with Marc Ellis could go a long way in making your journey easier. here is a link to his web site. http://www.marcellislaw.com/

His office is located in Ho Chi Minh. Vietnam can be a tough consulate, and you need to make sure you have all your ducks in a row.
